i have to go to immigration court on february, i would like to know what would happen ? i been here all my life since i was a baby 2-3, i was wondering if i can get a student visa, i am still in school, all i did was gave wrong date of birth because i was nervous.

If you are going to immigration court, either you had no legal status to begin with, or you have violated some law that will lead the immigration court to revoke your status and deport you. Either way, you should be spending less time telling us your story, and more quality time telling it to an immigration attorney.

You don't normally risk appearing in immigration court for giving someone the wrong date of birth, unless, you gained some benefit by the wrong date, like telling someone in a bar you're over 21 and subsequently getting arrested. I'm assuming the police checked you out after the arrest and you had no status. However, if you had some sort of immigration status to begin with, the immigration judge isn't likely to let you stay on a student visa after losing your green card. If you had no status to begin with, they aren't likely to give you some sort of status after being sent to deportation proceedings. So go get a lawyer and see what options you may have before they decide to close the door.

Uh, oh, they usually only send you to immigration court to stamp the deportation papers. The judges no longer have discretion and there is no papers anymore to file appeals for special circumstances or a stay of deportation. This is one of the big problems with the new laws, they don't take into account adults who have lived her since they were little kids, they can still be deported at any time. CONTACT a lawyer. file applications now for any visas, green cards, or citizenship if you can. Bring any school or other records that show if you work, support a fam, or whatever. CHECK out an 'AMICUS CURIAE' by AMNESTY INTERNATIONAL filed on behalf of immigrants. This will show the USA has signed and ratified constitutionally the rights for children to reside with their family, even if they are illegal, and children's best interests must be taken into account. Many of the new immigration laws are in direct violation of several Human Rights charters, UN constitutions, etc. Have people write you letters, school teachers, coaches, everybody telling how they know you and what good you do. BE VERY CAREFUL TO NOT COMMIT ANY CRIMES, AS BEING AN IMMIGRANT, even legally, AUTOMATICALLY UPS THE LEVEL, OFTEN FROM MISDEMEANER TO FELONY.

wrong date of birth to who or which agency, if you are in immigration court, is it because you currently have no legal status. don't believe you can get a student visa if you are in the u.s. illegally. but on the other hand maybe a good immigration attorney can buy you some extra time, but it is gonna cost you some good money and you may still have to depart unless the dream act passes in the near future.

Why do you have to go to immigration court?

If you are in the process of being deported it will be hard to get a student visa without the court's approval.

You should contact a lawyer before you appear in court. He would advise what to do and what not to do on your specific case.
