One would think so. However there are number of legal ramifications to consider. The 1962 inter-galactic treaty that was proposed by President Kennedy, right after his announcement that we would send a man to the moon, was the model that subsequent Presidents followed. While it is true that no other planet or extra-terrestrial beings have signed the proposed treaty, it has been in force since its inception. Call it a good faith gesture to any possible alien that has the ability to destroy us in a nano-second.
So, back to your question. I'm afraid we don't have the right to confiscate their spaceships. We only have the right, for safety reasons only, to hold them for 24 hours. Then the aliens are free to stay in certain amnesty cities like San Francisco and Boston.
It is a widely held belief that the aliens and their spacecraft are already well intrenched in the above mentioned areas.
