Filing taxes as married when you are not legally married is illegal. The IRS will come after you.

What state are you in?

In the states that recognize comon law marriages you may be considered married once you filed that tax return. (If so, you are married until you either get a divorce or leave the state.)

In all other cases, you need to file an amended return to fix the filing status(es) for the person whose name was first on the return (add an original single return for the 2nd person). You will have to attach a letter to explain why it was an invalid return. If you owe money because the refund was too large, you will have to pay it back with penalties and interest.

The common law marriage states that could recognize you as married are:

Alabama
Colorado
District of Columbia
Iowa
Kansas
Montana
Oklahoma
Rhode Island
South Carolina
Texas
Utah

You can't! You have to file seperate tax returns as single people. You have to decide who is going to claim your son as only one of you can. Of course, always consult a tax person if you're not sure.

Here's a crazy idea, instead of committing fraud, why don't you just get married? Then you can actually honestly officially claim you are married.

unfortunately, u are still single NOT married.
so get the license, then u can file married.
until that time u will be filing single or FRAUD.
