you tell police another car hit your rental car,they then ask if you have the name of the person who hit you--the reply is yes i have the name- the police then says -We cant handle this being that you have the persons name,it is now a civil matter..What do you do? In filing claims on this matter it is a problem due to no police report. I am at a loss.
This is for the state of NC.

Immediately after she hit me, i asked for her name, and insur. came into the house to call 911 - I dont KNOW the lady at all..after calling the police and getting the response i did - i then called the rental company who urged me and passenger to go to ER. Passenger and myself have injuries. Lawyer is saying no police report,no can help. Other persons insurance company - is willing to pay damage for car and our medical bills..however the passenger needs on going attention *elbow effusion,back strain* and has loss wages from job..

I think you have either a lazy or screwed up police department. They are still required to respond to file a police report, ensure calm is maintained and to check for injuries.

One of the first things you should always do is get the name, address, insurance id number, etc. of the person you're involved in the accident with, and also the name and telephone numbers of any witnesses to the accident.

I think you need to complain to the head of your police department, if he's not a complete moron also.

Honestly the police didnt have to come b/c it happened on private property, therefore there's really nothing they could do but file a report. Since they didn't come, for your best interest when something like that happens, you should go to the police station yourself and file a report, or most of the time they will take a report over the phone. Her insurance co is definitely going to want to see a police report, so I'm really not sure how this is going to pan out.

If you don't call me to THE SCENE of an accident, I can't very well investigate the accident. I can't draw a diagram of the roadway, or the position of the vehicles at point of rest, the point of impact, any skid marks indicating point of reaction to danger, road conditions, weather conditions, visibility, lighting, etc.

I would have given you a form for YOU to fill out (known as an SR 13 in Georgia) for you to make your own report for your insurance and said, "Have a nice day, call 911 next time and wait for me to get there. I'd love to help."

But if you're in Georgia, if possible, DO move your car out of the roadway so as to prevent another accident/injury. It's the law.

police respond to on site accidents and you dont even have to record info from other party if for example they get hurt and trasported to hospital. The police report contains everything you need to bring to attention of insurance company and lawyer. if you delayed in calling insurance company and it was considered settled then try small claims court but first talk to a detective to see if they concur. As well try to obtain banking institution of other individual just in case you win at small claims then they try to not pay up. You can then go to Marshalls office pay 35 dollars and present them with court decision plus bank other party belongs to so as to get your money.

Here in NY the police have to investigate every call regardless. It sounds like the officer was just being lazy that day. Now its going to come down to a "he said she said" matter. Who ever is more convincing will more than likely win.

IF THEY CANT DO A HIT AND RUN REPORT, THEN THEY NEED TO DO A DAMAGE TO PROPERTY REPORT. ALOT OF PEOPLE KNOW THE PEOPLE WHO VICTIMIZED THEM. JUST BECAUSE THEY KNOW THEM DOESN'T MAKE IT A CIVAL MATTER, AS A MATTER OF FIT ITS A CRIMINAL MATTER. I WOULD ASK TO SPEAK TO A SUPERVISOR OF THAT OFFICER. THIS IS ALL BASED ON THE FACT THAT THERE IS NOTHING ELSE TO YOUR STORY............................................ THATS GOOD THAT THE OTHER INSURANCE COMPANY IS WILLING TO PAY. BUT AT ANY MOMENT THEY CAN SAY NO WE DONT WANT TO PAY, SHOW US A POLICE REPORT.

Sounds like you did not call an officer at the time of the accident. Forshame.
After the fact, it becomes yousaid, hesaid.
If the other driver showed you insurance coverage, contact the ins co. Have all the pertinent data.
Date, time, location, his DL, ins number, etc.

once you know the person that hit you all you have to do it report it to you insurance company, if they other person doesn't have insurance and you incur expenses you take them to small claims court and sue for your expenses.

next time, don't tell the police you have thier name until after they arrive , then you will have a report to provide more evidence.

Exchange insurance info and let the insurance companies determine fault, most times they will just agree on a mutual settlement and each company absorb the damages.
