The conceptus has his/her *own* DNA. He/she is a unique individual. The tumor has the DNA of its host.
Furthermore, the tumor will kill its host eventually. The unborn human fetus doesn't kill his/her mother (though complications of pregnancy can if not properly managed). The human fetus him/herself, however only lives inside the womb, grows & develops and is born, usually healthy, to live a complete and separate life on earth. Ever see a tumor go off on its own to learn to walk, read, dance, play, create, sing, discover things, fall in love, help others, etc.?

To answer your first question. No, it does not need to be legally protected. To become or to deserve this protection one must have the protintal to actually grow into a humanoid form. Or must preserve the human live in some way. Either it be historical, biological.... Cancerous tumors do none of these to garner legal protection.
Second question, the conceptus and cancerous tumor are defined this way. You can see the clear biological defferences in the two.

Actually a cancerous tumor, is a fine example of evolution. When genes mutate this is what occures, not nice little bunnies, or puppies, but death. That is the truth of evolution.
