Taxes were included with my mortgage payments. All paid on time.Penalty has now reached $3000.00 and climbing daily. Ive called them, and faxed them copies of the $5000.00 (plus 3000.00 = $8000.00 now)delinquency letters I've recieved from the Town.They don't return calls!They just say "they are working on it".Its been 2 months since I was notified that the taxes were not paid.I dont know what else to do. I was just listed in the paper for tax sale! If I contact a lawyer, can I charge them for his services? I am at my wits end.

It's time to contact the authorities. They are breaking the law. Mortgage companies are regulated and who your mortgage company is regulated by depends upon where in the US it is located. A little research by you is in order. I would start with your state's attorney general's office. This is urgent and if you can you should pay your taxes. The locality where you live doesn't care why they are delinquent, just that they are delinquent.

For future reference, you don't HAVE to escrow your taxes and insurance. I pay mine directly to my locality and my insurance company.

Ultimately, it's your responsibility to insure that your property taxes are paid in a timely fashion. Your mortgage holder merely requires that you 'save' enough over the year to have monies to pay the taxes. In many cases, the town sends the property tax bill to YOU, and then you have to forward it to the mortgage firm so they can pay what is due.

If the mortgage firm didn't receive a bill for the taxes due, they're not going to pay for it. Your particular mortgage firm is reacting quite slowly to what appears to be some sort of mix up. However, when they DO get it straightened out, do not be surprised if you are required to pay the penalties and fines from your own pocket.

Do not CALL your mortgage servicer. Put all communications in writing via certified mail. If they do not remedy the situation within two weeks, consult a lawyer. As another poster said, the county will come looking for you, not your mortgage servicer.

Call them again and speak to a supervisor...if they do not rectify the problem as for their supervisor. Let them think you have contacted an attorney and her his advise this is your last attempt to have them fix the issue before your attorney files suit. Also, contact your tax collector office and show proof that the mtg company was supposed to pay the taxes and that you have contacted them with the issue.

When the taxes are ultimately paid, make sure that the mortgage pays the penalties with their money, not yours.
