There are times when the question isn't who is right or who is wrong, but could the accident have been prevented.

If you would hit the pedestrian, the police would do a thorough investigation before a conclusion could be drawn. The biggest question, could you have prevented it???

In most cases, the pedestrian has the right of way-unless they dart out of a blind spot and you hit them. Drivers are supposed to always be aware of what is going on around them. If you take a driving course like Smith or First Mile, you will learn techniques to use to watch for other people who aren't paying attention.
As far as the pedestrian getting killed, depends on the state and what kind of judge you get. All laws are shades of gray and subject to interpretation.
