i got rear ended by some psyco lady who chased me for about a mile with hi beams on and beeping so i stopped short and got rear ended. its her fault for rear ending me and the cops came and gave me a citation for her saying that i passed her in a no passing zone. i never passed her.

The Officer didn't observe the violation, so it will be her word against yours. Both your actions were dangerous.

take it to court. Odds are the police officer has better things to do that day, and so will the other lady. If the officer does not show, then it is completely your word verses her. If it caused alot of damage, get an attorney. Generally a letter from your attorney will "scare" the lady into just paying for the damages for fear a judgement will be made against her for more, plus the court costs and attorney fees.

just because you are rear ended does not automatically mean the other person is at fault.if the officer feels you stopped to quickly and were rear ended,it would mean you were at fault.there was no way you got a citation for that offense because the officer has to see it to site you.i never mind helping anyone with information but adding the citation for a fake deal makes one not want to help.

File an action to protest the citation because you are correct. Stand ground when in right.

if a citizen wants to file charges against you, the police officer MUST do it unless they find evidence that you are innocent. in driving complaints, they will write you a citation and then they complaintant has to show up in court and prove you did it. it isn't the officers fault, it is a citizens arrest.

since the officers didn't observe the violation, seems like u have a good case. Your word against her's. If you have witnesses take them with you, they'd help a good deal.
