My fiance and I got married six months ago. We recently opened a case with ICE (Immigration and Customs Enforcement) to adjust my status to a permanent resident.
I've entered the country legally, I have my own Social Security number issued to me by the Social Security Administration.
The process will take up to an year. In the mean time my temporary immigration paperwork has already expired.

I hold a valid Iowa driver's license. I checked on the Wisconsin Department Of Transportation web site - to obtain a WI driver's license you have to put down on the form that you are a)US citizen b)Permanent Resident or c)Temporary Visitor and prove it with the appropriate paperwork.

My question is - which option should I choose, and what should I tell the DMV clerk? Since I really don't fall into any of these categories. I'm no longer a temporary visitor and I'm not yet a permanent resident or citizen.

Or should I just keep driving with my valid out of state driver's license for now?

No no no, don't keep driving without a valid DL. You should have started the process of getting a green card right away. That would have enabled you to stay. Talk to an immigration lawyer. It might be that you have to go back to your country, and reenter on a different visa, or that immigration can extend your visa. Really, you should have not let it expire. Good luck. But talk to a lawyer quickly.

Well, that's why I didn't change my last name when I got married...if you want to be consistent and you don't want to renew your documents so many times, you just retain your last name until you file the N-400, which makes it easy to obtain your U.S. documents under your new name. Such a name change can cause problems and I think it would be confusing if you obtained your driver's license under your old name. In my opinion, you can do nothing but wait until your case is processed. I guess you had an official name change so you can't contact USCIS to get your green card with your maiden name on it.

If you drive without a valid licence and get caught you are likely to lose any chance of adjusting status and could be deported.
Since you can't prove your status you may lose your licence until you get your green card. If you have an NOA1 from USCIS that says your AOS is being processed they might accept that. If they don't you better get used to walking for a while. AOS needn't take a year, it only took me 5 months.

If you filed your adjustment of status before your visa expired, and if you received the receipt notice (RN) from USCIS proving that they have all the required paper works, then you are in the status of AOS. You can try to obtain WI license by bringing to the DMV the RN and other copies of paper work such as marriage certificate, proof of your spouse is US Citizen. If they cannot issue WI license, then you can use your IA license.

Well...guess what? You're illegal. If your paperwork expired you're now illegal. No don't apply for a Wisconsin DL and put ANY false info. If you have a valid out of state license you better have an out of state address also. Fraud will get you felony charges and you definitely won't receive papers to be here. Sorry
