My husband abused me Domestic Violence then closed
up all accounts left me without a dime. Now someone told
me to file directly to VA for Spousal Support he is 100%
disabled, unemployable, perm disabled by VA so he gets
VA & SSDisability making over 3900.00 monthly plus
yearly uniform allowance of $600.00. So I recieve
SSDisability 975.00 a month and now does anyone
think I should bother writing the VA to impose monthly payment. I took care of this man I was sole driver in marriage,
all housework, giving his meds and 2 x a month shots. The VA
taught me how to do that it was painful for me to hurt him. He
said I gave the best/easiest shots but it hurt me to do it.
Anyway any thoughts would be helpful. Oh I was the main
parent to my husband's son. He is now 18 and his birth mom
still thanks me for raising her son she said she could not
have picked a better mom for her birth son. We talk weekly. I was married 12.5 years now separated.Husb. controlled my
life.

Whether divorced or separated, you should contact a VA representative with your questions. Laws have changed. If the 12 years you lived with him especially is recent, because now, spouses are entitled to retired pay. You will need his date of birth, SS#, and a DD 214-the form he got upon retiremen, a copy of your marriage license, your SS# and your birthdate. If you live near a military base, some of these questions can be asked of the VA representative at the base.
I am currently helping someone else with a VA claim whose husband was 100% disabled but the case is different than yours. Make sure anything you send VA is a certified copy and send Certified mail or FAX. I hope I have been of some assistance to you.

His VA benefits are his alone. If you are not divorced and he has moved out, then he will not get the extra allowance for assisted living (that's what you get paid for).
If he has someone else taking care of him, notify the VA and he will have to verify that someone else is assisting him.
As far as getting any of his benefits, sorry, you may be out of luck.
But no harm in trying, he at least owes you something for taking care of him.
