If there is no custody agreement set down on paper then she is allowed to take the child wherever she wants. Unless you have a custody agreement (or you have primary custody of the child) she is allowed to go wherever she wants, without you winning any agreement by default, because she's technically in no violation of any agreement.

Without a custody order, both parents have custody & can do as they wish when the child is with them.

If there is a custody order, it should spell out provisions for moving the child away from the other parent.

As long as you have partial custody over the child she can't take him out of state. But other than that she can take him wherever she wants. She just can't take him out of state without the father's permission.

Unless there is some sort of order preventing her from taking the child...she can take it wherever she likes.

She is the mother and has every right to do that until an order says she can't.

Depends on who does have costody. If it is you then that is up to you, if it is someone else then it is their say. If you havent been to court yet then she can take your child wherever she wants.
