My ex has residence for our two children because I cannot afford a home for them.Although no custody order has been made he acts asif I have no say over the children.

When one parent has custody, or when the child lives primarily with that parent, they have major rights that the other parent doesn't have. An example would be, what school the child will attend, doctor, dentist, orthodontist, optomatrist, what day care IF they attend a day care, what sports the child plays as long as they don't fall on visitation day. The non custodial parent would have legal access to the child's medical, dental, ortho, & school records. The custodial and non custodial parent would have to abide by the order and have visitation on those days. They would have no right to schedule ANYTHING on the days that are NOT theres. So you see, it can be quite involved. If you do not have anything legal, get something. If you can't afford it, I would see how you could go about using Legal Aid or find a way to do it with a lower cost attorney. Good Luck

If no custody order has been made then you share custody of the children and he has to let you see them and share equally in the decision making concerning your children. You need to take this to court and have it made legal. You could probably get the authorities involved if he is not letting you see your children.

He'll probably get custody and you'll probably get visitation and have to pay child support. Obviously, he can provide a better life for the kids.

You need to talk to your lawyer.
