Ok, I need to ask this again, and add some info to it. My husband is on long term disability, so he doesn't get taxed, but still has to report it on his taxes. He owes from last return, but how do i file if I don't want to pay his taxes, but I want to inlcude him because the refund would be bigger if he is on it, we claim 2 kids, and a house. I fugured with just my income being taxable, our refund would be more but i don't want to file with him if there is a chance they will snatch mine for his debt.

If you file Married Filing Jointly, your federal deduction will be $17,500. Then two exemptions of $6800 for kids. Then you may get Earned Income Credit. You may get Child Tax Credit of $1,000 for each child.
You should calculate your taxes as Married Filing Separately and Married Filing Jointly. May be, by filing Married Filing Jointly your saving of tax is more than what your husband owes from last return.

If your husband owes back taxes and it was a joint return with you, then IRS will offset your refund check. If you file a joint return now IRS will offset the refund to his debt. You could file injured spouse and half of the refund will not be offset. Usually takes at least 6 weeks to process an injured spouse request.
When you marry, you marry their debt.

I know in our town we have an IRS building. Just go down there and tell them your problem. I don't think they take phone calls (around here you have to walk in)

Its a good time to do it beause its not tax season.

Couldn't you just file "Married filing separately"?
