I split with my sons father the day i was due.16 months ago because he was a dropkick and wouldnt get a job or get anything for the baby, i got away with not putting him on the birth certificate so he doesnt pay maintenance (even if he did it would be jack all coz he is on the dole) but if i ask for a few dollars he will lend it to me, and he used to see my son once a week with me there, but he hasnt wanted to see him for a month
anyway i have started seeing someone and my ex found out now he wants to file for joint custody or something, he has bipolar and can get pretty violent that is why he has never once been left alone with my son because i am scared he will do something,
i know he is just doing it because he wants to hurt me,
will he get any form of visitation and can i refuse for my son to be dna tested?
i am just bugged because everytime something good happens something bad always follows.
i do not trust him not to run off with my son either just by things he has said b4

No, you cannot refuse paternity testing if a court orders it, and yes, your ex could very well get custody and/or visitation rights.

You really need to find a good lawyer, like NOW. Sit down and document everything you can remember about payments your ex has made, visitation dates, comments he has made regarding running off with or harming your son, instances of violent behavior, and whatever you know about his bipolar condition and financial state. From now on, keep a notebook with you and make a note of any comments or behaviors that cause you concern - include dates/times, places, circumstances, etc.

Good luck.

I cant tell you how you should handle it but the way I handled my situation, which was similar, was I told him that if he wanted a DNA test to get a court order. Until then he wasn't getting **** from me! If he does follow through with getting a court order then I would follow through with getting some legal advice, however if you do not want him to have visitation rights you have to prove that he is an unfit parent and has a violent history and is a risk to you son! Still even then he might still get supervised visits. It all really depends on your lawyer and the judge that you get! But good luck!!

I would get legal advice, but keep in mind that in most cases, if the father wishes to have some visitations, then he will usually be allowed to access the child, whether it is supervised or not is more a matter for the courts.

As for the DNA test, why do you not want one.....were you planning on saying that your new boyfriend is the real father? I think for the benefit of the child it is best off being honest, and letting the system do what it is in place for.

Ugh.

If you knew he was bipolar, pretty violent and a 'dropkick', why did you decide to make him the father of your child?
