He won't get into trouble. It was parked. You don't NEED insurance to have a car parked.
Go through your insurance. It's not his option!!

There is a "No pay, no play" law. Look it up. If they were driving without insurance, they took a risk driving that way. If they file with your insurance, chances are they wont get anything, and they will get a ticket. (If police made a report, doesn't sound like you called them, though)
If you want to be nice and pay for damages, that's your prerogative. But if you didn't have the money to do that, they would still have to make a claim under your insurance. Your insurance will open an investigation (they always do) which will easily reveal they didn't have insurance. Your insurance company isn't going to pay money unless they have to. So that's where that law comes into affect. If they don't pay, they don't get to play with damage money.

If his car was parked, he wasn't driving without insurance at the time of the accident, so trying to claim he was performing an illegal act won't fly. Your options are to report it to your insurance company, or to pay the damages directly.
Either way, you backed into a parked car, and are responsible.

The fact that he has no insurance does not have anything to do with it. His car was still parked and you still backed into it.
If you took out your magic wand and presto change-o his car has an insurance policy - the accident still happens. Therefore, his not having insurance does not affect fault.
I'd just go ahead and turn in the claim to your carrier. They will pay him for the damage to his car.

offer him your deductable (what you would spend anyway) or go through your insurance. Unless the repairs are not much more than your deductable, don't pay out of pocket for repair cost. Most insurance companies forgive at least the first accident.
I always felt that if they are on the road without insurance they shouldn't have been there anyway so it should be their fault or no ones fault. I have to pay extra every year for uninsured motorist coverage to make sure that I'm protected so why should I have to pay people that have no insurance? They aren't suppose to be on the road for me to hit.

It was your fault so contacting your insurance company has nothing to do with his insurance company. He doesn't have to involve his insurance company or lack thereof.
You can either go through your insurance to have the car fixed, or offer him money to fix it.

Unfortunately, regardless if the other car has insurance or not, so long as it is your fault (which is clearly yours at this incident), your insurance is liable for paying the damage to the other car. So if he goes through your insurance, this would be considered an AT FAULT COLLISSION.

report it to the police as his driving with no insurance is illegal and i bet then your insurance company will not pay him anything
