I was in a wreck and it was the other persons fault, the cops came and sited the man. Yet, the man refuses to give me his insurance? What can I do?

Thanks for the responses. Unfortunately my insurance says because it is below the deductible then they won't do anything about it because they didn't have to cover anything! Why am I paying for insurance again?

The deductible is $1000, the cost of the damage was $900. The guy was sited by the officer for being at fault and for not carrying insurance. He showed up at the courthouse and showed that he had insurance....the court house didn't get a copy of his insurance. Therefor, I pay $900 and he gets off for free because he REFUSES to give me his insurance.

The police should have taken down all his information. You should call your insurance company, give them the # of the police report & they will make sure he pays. Worst case scenario is you would have to take him to small claims court, but your insurance company should do the dirty work.

Get a copy of the police report, which is your right to get. I would assume its the same in all states, but since it is against the law to not carry insurance, the police officer more than likely included his information on the police report, including his insurance company and number.
If the cost to pay for it is below your deductible, the insurance is not obligated to pay. Say it costs $400 to fix it and your deductible is $500, you would be responsible for the first $500 in an accident...why would they have to pay anything?

He doesn't have to give it to YOU, he only has to give it to the cops.
But as you were in the wreck, you can get a copy of the police report in a few days - then you'll have the info.
On the other hand, if you just report it to your insurance company, THEY will track this clown down and collect for you.

Your insurance should handle this for you. That said, you may be able to get a copy of the accident report from the State Patrol to help move this along.
If you didn't have insurance but need to fix the blame on the other person, you will need a lawyer to go after him/her.

Call your insurance company with the man's information. Let them know he wouldn't produce any insurance to you.
The only other thing to do is get the police report and take the man to small claims court.

If you have a copy of the police report, than bring it to the insurance company. They will find out his information if he has insurance.

He should have given the information to the police. Yes, by law you are required to provide your insurance information if in an accident. If he didn't, you should have his personal information, give it to your insurance company and let them go after him.

I just went through this in March. Get a copy of the police report, he had to give his ins. info to the police. Give the police report to your ins company and/or lawyer. That's all.
