No, they can't...same situation here, but we're married now. Be sure to put your name on the bank account, he can be on there but only as a co-owner or have seperate accounts. They can't freeze your bank account and if he pays them monthly payments they can't do it to him either. Be sure he pays them on time every month, you can get a Power of attorney to be able to talk to the IRS in case there are any problems, you'll be in the loop too. File your tax returns separately. You owe them nothing as long as you weren't married to him when the debt occurred. I know a lot about it. If you have any questions feel free to email me.

Creditors, including IRS, can not collect from your separate assets but they will be an albatross around your neck. If you are not able to resolve his debts before saying I do, you should have an attorney draft an iron clad pre-marital agreement to protect you. If you would like to provide money to fund a settlement with IRS before marriage, that is an option. In my practice as an enrolled agent who specializes in this kind of problem, I had one fiance who paid about 15 cents on the dollar to make his dearly beloved's problems go away so that he didn't have to marry a tax problem. I do not know for sure about the IRS i do know that certain debit incurred before marriage they can not get from you. I know this from personal exp. I married last year and i had a debit i incurred years before they tried to take my new husbands taxes but could not do it because it was before we got married.

When you marry a person, you also marry the persons debts. That is why everyone should do a background check on the person they are about to get involved with.

No, not money you had before you were married. If you file a joint tax return though, you'll have to file an injured spouse form with it or they'll take the entire refund including the part due to your income and withholding - if you file the form, they'll just take his share.

If you are in a community property state, rules can differ so check with a CPA.

Happened to me...been divorced 12 years and I am still dealing with that ****!!!! He cant really hold down a job or works under the table, moves around alot...so it's me that gets to deal with that and I am the one who actually paid my taxes!!!

If you answer California, don't get married until the bids are paid.

well if you have a good bit of money then yea they are going to go after you!! but if you have your money hidden...... as in money that your future husband doesnt even know about, then no beacsue he IRS would know about the money. (get an offshore bank account! really!
