Yes it is in force, but if the car you are driving is privately owned by you (not a company car) then there is no law to stop you smoking in it.

It depends on the car. If it is a company car or a vehicle that you use for work (such as a workman's transit van) then it is illegal to smoke inside it. If it is your own private car then you can, for the time being, smoke in it. There are proposals to ban drivers from smoking while at the wheel but they have not even drafted a bill yet, I don't think. In my opinion it's a damn good idea: 2000 kids a year die on the roads in Britain due to people exceeding speed limits or not paying their 100% attention to the road. That's far, far more than are killed by the evil paedophiles lurking on every corner (that's about 4-6 a year, by the way).

There is no smoking ban relating to private vehicles - only vehicles as a "workplace".
What has happened is that the latest version of the Highway Code has pointed out that it could count against you if you were involved in an accident, as it could be held that you weren't in proper control - as always has been the case.

Smoking is not banned in cars as such.
However it is banned in all "enclosed workplaces" in the UK.
This includes any company-owned vehicle in which employees other than the normal keeper may travel (unless it is a convertible, in which it is not an "enclosed workplace" if the roof is down).

There is no outright ban per se, but if the police feel that a person's smoking while driving is causing dangerous or negligent driving you can be prosecuted

I've never heard of that ban.. Why should it matter if people are in their cars, alone, driving and smoking? It's not like they are going to be able to smoke wherever they are going to.
I don't smoke, but I think the whole 'freedom to breathe act' is a load of crap. It's your choice to be in the area that people smoke, if you don't like it then go away from it.
