There was a misunderstanding a couple of weeks ago that left bf with a no contact order and want to know how we can resolve this.

We were having a heated verbal arguement on the street in the wee hours of the morning and i stumbled and fell and when he tried to avoid letting me fall we both went down. police showed up at that moment and arrested him with domestic assault. APPARENTLY there was also a witness, but it REALLY wasnt what it must have looked like.

How do we fix this????

To "it's irrelevent to me" why post then??

It WAS in fact an arguement, which started in house and began again while out. I did not call police, someone driving by called police.
The weird thing here, i was not even questioned, i was not asked for a statement, i have completely dissappeared in this entire case and that's why I dont know what to do about it. No one is listening, or interested in my part of this whole thing.

I think I will pursue my rights in filing a complaint. Thank you

How do we fix this???? - First stop telling lies for him. I don't believe you, the police don't believe you and a witness does not believe you.

Second, don't even talk to him until he apologizes and enrolls in an anger management class. If he misses one class, run (don't walk) away.

I have always said that a person that gets beat and does not prosecute the perpetrator deserves the beating they got.

As a retired officer I can't give your story any credibility. Your saying you had a verbal argument and an injury appeared due to your both falling and now you want to drop the matter...

Time and again I have personaly dealt with this same type of case.

Is it possible you were hit, made a big complaint about it and now want it to go away as you and your BF kissed and made up?

This is the typical scenario.

I doubt if the courts will drop the matter but you can always contact the district atty and request the case be dismissed, yet, I have never heard of it being done before.

If you do believe it is a misunderstanding than the only thing you can do is defend him. I watched an episode of COPS and in some states arrests for domestic charges are mandatory (a assulted victim could injure the other person to retaliate or the assalant could make injuries worse).

ok...well....here is the best answer i can give you.....the police officer had done something wrong in his job by the way you are telling this story....you are saying you both went to the ground.........

if that is the case no one should have been arrested.....the only way the cops can legally make an arrest is if he pushed you on the ground......or if you pushed him on the ground, in that case you would have been the one arrested,

but anyhow...the way you are describing it, it sounds like an accident.......the cops should NOT have placed charges on either one of you......I would file a complaint against the police department....you could do this by going to the county courthouse.....your next step would be to go an attourney for a consultation.....being that he was the one arrested for domestic violence against you...(whether he did it or not)....it is YOU who decides to press the charges or not........what a cop is supposed to do is ask if you want the charges placed on him...if you say no, he will still be arrested and be in jail for just a couple of days....but he is NOT supposed to be charged......

Like i said in one of my other answers, the law enforcement field is NOT perfect as people think it is.......there is corruption......and i know actual police officers who are in jail because they thought that because the law was on their side, they were above it.....

so file a complaint at the court house, and consult an attourney...you may also have a civil case against the police department.....

Amendment 7 of the constitution states you have the right to jury trial in civil cases...this IS a civil case......

people let the law walk all over them, because they believe they are helpless against it.........DO NOT let this happen to you......you should obey the law, NOT worship it!!!!

It will need to be settled in court. Many areas have gone to arresting someone when domestic battery is involved because there are times when a person will call police and then refuse to press charges.

It's irrelevant to me. You sound like you deserve each other.

Do you realize that most of the people in the U.S. don't get into screaming fights on the street in the early morning hours? Do you realize that your behavior is maladjusted and shows a distinct lack of maturity?

Or, do you think it's perfectly OK.

I have seen domestic violence trials and I can tell you, its pretty simple. If the victim says she wasn't assalted, the judge will drop the charges, end of story. The first poster can't give a all-around solution to a problem like yours and...you'll just have to decide.
