So my 20 yr old brother was just walking at night when all the sudden cops are screaming at him to get on the floor while a cop puts his knee on his back. checks his backpack finds nothing but his breath smells like alcohol but not drunk at all, then keeps him all night & day long not telling him what he did wrong & the next day finally calls my mom & charges 500 dollars & yesterday sentenced him for 3 days in jail with no contact with us. doesn't this sound harsh!!!!!

i did forget to say that while he was waiting a woman was near him so my brother got frustrated since she was very unreasonable by not talking to him & even telling a cop he was talking tonot to talk to him so he banged his head & THAT's what they sentenced him two days in jail but it's not clear why they fined 500 dollars but I guess he had a curfew outside. ltr lemme see if i can get some deats. thanks a bunch for helping me!

hes lying to you, my brother had a similar incident, it was months before he told us what really happened and why he was really jailed

get a lawyer involved...they will check the report (all police have to file a report) and advise your family. When someone goes to jail then immediately they can ask to make one call and it can be either to his parents (asking them to find out what's wrong and to call an attorney) or to phone his attorney. In any case he should have asked for that call. I can't say that he argued with the police or he was throwing punches at the police, or they found something on him, or thought he was someone else or someone said he was involved in something or whether he was cussing at the police. If he was drunk then usually police pull the guy in and let him sleep it off till morning. But they should have allowed him one call in the morning at least. Police can't hold someone unless they have a reason. If he did do something then staying in jail a few days would lessen his sentence. Usually if they keep you for a few days then at some point a person goes before a judge. Were there any charges pressed against him? Does he have to appear before a judge? Overnight could be just for being drunk and disorderly. What was he sentenced for? Seems like you are missing some important information.

Boy, what police state do you live in? When you are 20, if you "smell like a drunk" you have consumed alcohol illegally whether you are drunk or not. As for the rest of the deal, it sounds rather high-handed, and perhaps you are attributing things to the police that are being done by the magistrate. Moreover, a 20 year old is legally an adult, so the police don't have an obligation to contact you. You might want to review what happened, and if it is as you say, get a lawyer involved.

If all your facts are accurate, yes the treatment is unwarrented and harsh. Unfortunately we live in times that bullies have all the power so there is little you can do unless you find an attorney that has an angle to make some money from exposing it.
I have seen incidences where the police locked up a man stating he looked drunk, turned out he was diabetic and going into a coma. He lay in jail for almost 24 hours in a coma when the morning shift came in and one sensible officer did an accu check on him then called the ambulance to get him to the ER. I never knew how the case turned out but thought it was funny when we realized his daughter was an attorney in NYC.

cops can't charges fine and sentence people. it sounds like he had a hearing.
it's not clear that you have the entire picture. it doesn't sound right, but whether it's legal or not, i can't say with what you've written.
i assume that the legal drinking age is 21, so you bro broke the law. he may have been held in protective custody (overnight). i believe he has the right to a copy of all his paperwork. i suggest he obtain a copy.

You don't state what he was charged with?
You need to provide the whole story not just the parts you want to.
If he wasn't charged you can take an action for false arrest. But its sounds to me there's more missing from your claim.

well that would depend on what they charged him with. I would think they should have told him why he is being held. I dont think they can just arrest you and hold you for no reason.

Alot of cop suck and it depends on where you live. I live in crooked county wisconsin and the cops around here do whatever they want.

It would help to clarify exactly what the charges against him are. I suspect this story is a bit incomplete, as a person has the right to be informed of what they have been charged with.

yah it is a little harsh but 1. Ya bro is under the drinkin age. 2. depends on where u live, i live out in pa and the pigz out here think they runn erreything. also depends on how late it was and if ya bro did anything stupid or anything to piss someone off.
