It depends on the law in that particular jurisdiction. If you yell it out, it could be considered 'causing a disturbance', which may or may not be an arrestable offence. I'm not aware of any place that would make it a crime to say it, as long as it's not yelled out in public. The answer above indicates at least one place where it could be, even if only the cop was close enough to hear it. Regardless, in your case I doubt that any arrest would be made even if it could be made. First, maybe the cop would agree that the charge is BS. He/she may even say that they agree with you as they hand you the ticket. Second, he may have been planning to give you a warning for a minor traffic offense ... you just won yourself a ticket, not a warning. Third, you may have just convinced the cop that it would be a good idea to (1) thoroughly check your car for equipment or safety violations, (2) Check all your documents to ensure they have all been properly signed and are legible, (3) check your name on the computer for everything including minor warrants that he would normally tell you about but not execute, (4) He may only have wanted to bring something to your attention instead of making it official with all the included paperwork, etc.
Any cop will tell you to always be polite, only 'yes, sir' and 'no, sir' and 'I didn't realize I had done that and will be very sure to be more careful next time, sir'. That really works. Give him/her an attitude and believe me, you *will* lose. I'm sure every cop on this site gets a good laugh reading some of the nonsense on this site from scaredy little nothings that always claim to have punched out a cop or really told the cop off, etc. What a laugh that is. Those are the kinds who cower down in their seat and almost cry when a cop approches them. The big stories come later or on YA. I hope this answers your question. Good luck!!

I called three of them @$$holes. Two at a traffic stop, and one at a police station. I didn't get arrested. They could not, my civil rights protect my freedom of speech.
However, if I did that creating a disruption, they'd take me for other reasons, but not for what I said.
Now, my haters here will bluff when I admit this: One of those officers became someone I absolutely respect and adore today. After stopping me one night just because I had a Spongebob Square Pants hanging from the rear view mirror and giving me a ticket, I called him the expletive and drove off. I was infuriated because I would have to take time out of this new job to go to court and dispute it. By the way, it was dropped immediately just because I showed up.
But one night I had to call the cops on some hooligans and guess who came to my house! This cop was so helpful that I had to bring up that incident and sincerely apologize. He explained to me that the real reason why he stopped me was that often some dopeheads hang things from the mirror to signal that a drop was made somewhere. So, he was checking up on suspicious activity that had been reported earlier...
Turns out that this individual helped me in other situations later on and I even ended up giving him a thank-you note and a basket of candy. Go figure how far a good action from an officer will go!
And the other two? Well, one gave me a ticket for driving 61 in a 55mph zone. After I called him like it was, I never received anything in the mail about that ticket or from the court. I never paid it, and I am not in any list. I wonder if he realized how petty it was and dropped it altogether... And the other was sent back to a few sensitivity training classes at the academy as a consequence of a complaint I filed against him...

I don't think they can arrest you for swearing, but they would probably treat you with disrespect after the fact. So keep your cool if you ever get pulled over. It's really best not to question the coppers.
