Is our Constitution being upheld? If not, how not?

I don't think it is perfect. The writers were all white male rich landowners who were trying to avoid taxes. In addition, many were slaveowners. There's no right to privacy listed, etc.


But yeah, I actually think it has generally been followed over the past few years........or as much as in any other time period.

No one did more to weaken it than FDR.

Believe it or not, I'm not American (I'm Canadian) though my husband is, and I support the Constitution of the United States. I think that its not being upheld. The Patriot Act is not upholding the freedom of Americans. Nothing the Shrub does is upholding the American Constitution.

In fact, its very disturbing to watch whats been going on.

It's one piece in a larger framework that includes the three branches of government and every citizen. I support the ideas behind the creation of the system and framework. You can't remove a piece of the whole and ask a broad question like yours about the piece.

Your question has no meaning. Far too many people get foolishly drawn into these kind of questions. The constitution is not a static document and was never meant to be.

There have been many things contrary to the Constitution for a long time. Putting the English Christian god's name on all of our money and in the Pledge of Allegiance under eisenhower violates the First Amendment.

Yes I support it, no it hasn't been upheld. The "Under God" addition to the pledge of allegiance during the "Red Scare" was the first major infringement on the separation of Church and State. The Patriot Act is among the latest.

I spent 12 years of my life defending that Constitution and still do.

This administration has tried to erode it the best they could but sanity is prevailing once again. It's taken so many years to get the population to follow it from its start. More is needed (mostly getting religion out of government), but at least the majority has the right to vote this century ; )

Yes, and parts of it are. Last year was a pretty bad year for its civil liberties provisions, but looking at the court's upcoming cases, I'm hopeful.

In particular, I'm hopeful about the revisiting of the Guantanamo Bay situation. Kennedy appears, if we read his decision to review the case correctly, to be growing tired of the executive branch's abuse of power.

I support it, but the courts have been doing more interpreting than upholding, and that's never a good thing.

there are chaplains in the military, so it's not being upheld in that regard.....i bet you're horribly offended by that too
