My uncle has died and he did a will and my mum was in his will. My aunt and cousin was saying my mum is trouble when my mum is not trouble at all and my uncles son chucked the cheque on the floor we wasnt there cause we wasnt told at the time. If my uncles will is proper can my uncles sons take my mums money from my mum. Thanks for answering. Everyone there was a shamed of my aunt and my cousins.

If your uncle left something to your mom then she's entitled to it,as long as it was in the will.It's nothing they can do about it but azz up off it.Your mom don't need no attorney unless she is not in the will and she think something is owed to her.

If you live in the US probably, No. Normally, The person who is responsible for probate and the Executor of the Will are requires to give the money the way the Will asks, unless a judge changes it.

However, if you Cousin refuses to pay the money, she will have to go to court to get it. So get a lawyer.

I think your Mum should talk to the Citizens Advice people. She probably does have a legal right to whatever was given to her in the will and the Citizens Advice can help her for free to find someone to sort it out.

You and she need to remember though that death and grief bring a lot of emotions with them, one of them is anger. So you should give your cousins and aunt some consideration as they have just lost someone they love which is about the hardest thing in the world.

It doesn't matter if your mum was trouble or not. The will is a legal document. The law says the money is for you mum. Talk to the lawyer who made up the will. If there was no lawyer, then get one. Good luck.

No he cannot. You need to find out who the executor was and contact them to arrange payment of what is due to your mum. If you are in the Uk and the will have gone through probate then you can get a copy of it for about £5. In the meantime tell your mum to go to the CAB for advice.

No, if the will was created properly in the presence of a solicitor, then it will need to be honoured. Your uncle shouldn't have any opportunity to take the money away, because the will should be read by the solicitor, who will be responsible for ensuring that everyone receives their entitlement.

Your relatives are jealous and self-centered fools who are trying to blame their problems on your uncle naming your mother in his will. Now, your relatives will probably contend the will, but for a more solid approach, check with an attorney of some sort for answers. Your uncle named your mother, and I don't see how they can cut her out of everything, but it won't hurt to check.

Everyone on here who answered your question is so right, I dont know how I can add anymore. You really need to get a lawyer because you are in titled to money and you deserve it.

No one can take from your mother what is rightfully hers. If she was supposed to receive an inheritance, she can go to the estate's attorney and ask when to expect her inheritance.

No your uncle's sons can't do anything about it, unless they take it into court.....
