Married but been separated for about 1year.We both file our taxes head of household since we arent together. He is now incarsarated and he would like me to file his taxes, leaving me with any refund he may receive. Is that possible?

I think a file in a cake would be more suitable.

Clearly he does not qualify as head of household, since he did not have a qualifying child in his household, nor paid half the cost of a dependent parent's household. The same might apply to you if no children lived with you.

Also, people in prison tend not to make a lot of money, so he may not even be required to file a tax return. If that is the case and if you have more income than the total of your standard deduction and personal & dependent exemptions, it may be to your benefit to file jointly. This might also be true if you qualify for the earned income credit.

Whatever you do, start early because his return will pass through a lot of hands before it gets mailed by the prison to IRS.

I really think that this one is over your head and you will want to at the very least consult a tax professional to review your tax returns. There are so many possible outcomes that it is impossible to tell you with the minimal facts provided.

Not sure how long he's been in jail, but he may not be eligible to file as head of household this year.

Generally, to qualify for head of household status you must have paid more than half the cost of maintaining a household that was the main home for a qualifying person for more than half the year.

If he qualifies for a refund just put in your bank info for direct deposit and the money will go right into your account (no check to sign, etc.). BUT he should sign his own tax return.

You can file as married filing jointly reporting your wages and his prisoner wages, if any. Both of you must sign the return.

BTW it is incarcerated not incarsarated.
