nope, the drunk driver is 100% liable and his/her insurance co. wont cover any damage

Yes! You can claim under a policy for damage/ liability cover - Unless the insurance policy you have has a 'drink/ drugs' exclusion clause. The only company I know of that has this is Quinn Direct.

Even under that case the insurance company would deal with the claim - they would just ask the policyholder to pay the costs back to them.

If you have been hit by a drunk driver there should be no problem - what happens to the driver will not affect your right to make a claim.

as no where in the policy does it say they wont cover you however if the drunk thinks they will still have insurance afterwords i think not unless they are willing to pay a premium for it its called high risk insurance and its pricey

dont drink and drive the life you save may be your own

If you were the one driving drunk, generally, likely not.

Many insurance companies will have clauses in their policies stating that if your are engaged in a criminal activity (and driving drunk *is* a criminal act) when the accident occured, they will not pay-out.

Now, if the OTHER driver was the one driving drunk, then yes, you can claim on *any* insurance policy.

No.YOU were doing something against the law when it happened. They aint gonna pay for something illegal that you were doing that caused/may have caused the accident. If the accident involved another vehicle, theyd probly pay for those damages,but then expect to be reinbursed by you either by you paying them voluntarily, or by suing you. Probly cancel your insurance too, depending on the severity of the accident.

No - and your insurance company will not pay out to damage done to the drink drivers car or any damaged third parties. (UK) If you was hit by a drunk driver you can claim on your own insurance but it may effect your no claims.

the motor insurance is in force and the insurance company is forced to pay out to any third party that is injured or car damaged they are not required to to pay for injuries or damage to the drunk driver or car ANY THIRD PARTY CLAIMS must be SETTLED BY THE INSURANCE COMPANY AND YOU DONT HAVE TO CLAIM ON YOUR OWN INSURANCE WHOEVER SAID THAT IS COMPLETELY STUPID

If you were over the limit, then the answer is no. If the other driver was over the limit and has insurance then the answer is yes.
