here is the thing... my mom has this credit card and she has a balance of $2500. She stoped paying it because she can't afford anymore. However, the credit card sued her and when she saw that she has to go to court, she called them and settled with them for $100/mos and the toatal came out to $3600. Over the phone my mom said yeah yeah yeah i'll settle with you. When the papers came and she saw what the amount came to, she does not want to pay... i have to questions: 1) what could happen if she doesen't pay...?
2) what can she do now ?
please help

this is another example of why everyone should never use credit cards. She is going to pay more than the $2500 no matter how she does it because that is how credit card companies work. If she doesn't pay it can ruin her credit but if she still has a good credit rating she may be able to borrow the money from her bank to pay the credit card off and pay less interest to a bank. If she does go to court, they may work out some type of payment plan but they may add court costs as well.
She can try to talk with someone about her credit, a counseling firm - I will give you a link for that - and they may be able to help her as well. If you find a local credit counseling group that may help but don't get involved with any that want you to pay them money before they do anything because that also can be a scam. Good luck to you!!

She has to pay the bill... JUST LIKE EVERYONE ELSE... just because she doesn't want to pay off the card because she "can't afford" it... that doesn't matter to the Credit Card company... they didn't force her to run up a big bill she can't pay... that was HER FAULT... if she refused to keep her part of the agreement, then the Credit Card company WILL come after her and they WILL get a court judgment against her and they WILL take everything she has to satisfy the bill.

And THAT is the way things work in AmeriKa these days... people are responsible for WHAT THEY DO.

They can sue his estate. He was smart to get off the deed! As it's no longer part of his estate, it can't be touched by any of his creditors. If they're in a community property state, check with an attorney but removing his name from the deed may still protect your Mom from losing it. There are some tax rules relative to giving property away in anticipation of death that could affect the taxable value of the estate but if the net value is less than $2 million there won't be any taxes due so that's a non-issue. Again, check with an attorney but it looks like your Dad took good care of your Mom on this one.

While a person may not like being sued it does have some good points.

1) No more over the limit fees

2) No more late fees

3) interest rate becomes regulated by state law.

The bad part is a court order that says you owe them that much money. All that court is deciding is how much is owed and owed to whom.
Collecting the money is another matter.

She's not going to prison.
A good idea was mentioned - go to a credit counselor - they're usually free or low-cost. Look in the phone book.
They will negotiate with the credit card company and make payment arrangements.
$2500 is not a lot of money.
Hopefully, your mother will learn from this situation to not just ignore a problem (they never go away) and to not just agree with someone to shut them up (it never works out well).

If she doesn't pay she will be sued and may be found guilty and she will have to pay twice as much or sit in prison. I don't know whERe do you live so i can't say the amount of time she will be sitting. If it is Germany then 1 month if USA then maybe 5-6 months.
I can advise you to make a deal to the people that you own or your mother will have to work all day long.

They reset the lawsuit and add the additional costs to the bill; and show the judge she reneged on an agreement to settle.

Pay them. Sooner or later. Check to see what a judgement does in your state; check with the clerk to see if they will be able to attach her wages or bank account. IF so, 100 a month might look pretty good.

She has to pay... You can't just not pay. They will sue again, And it will look worse because they gave her a chance and still she messed up... Pay it. Take out another credit card to pay it. Than stop spending money and pay off everything first... I have money but i can survive on no money becasue i live at home... But dont buy food
dont get a haircut dont get new clothes... Till she pays it off

hey i'm not very good with these things, but i do know that if she refuses to pay it will only get worse.

Because she didn't pay in the first place they have charged her more, probably interest

she has two options, either she pays off the balance (with the extra charge) and becomes debt free

or

She will get chraged even more and be taken to court again and most likely have her things taken, perhaps have the house reposessed, all her stuff will get taken away.

I hope that you are ok, your mum needs to get this sorted, it is very serious, they will do anything in their power to get their money and they won't stop till they get it.

if your mom doesnt pay, the credit company will run after her properties to pay for the debts...

if your state has insolvency or bankruptcy laws, then your mom may file an insolvency or bankruptcy proceedings before the court... and, if the court will approve the application, your mom's debts are considered erased...
