Hi there... I bought car from private owner on 3 weeks before. He gave me car tag and sale deal for that car. As it is first time, i am buying car in US, i didn't know that i have to ask for title. After 3 days i went to tag office to register that car and find out I need to have title for registration. Then that guy said that, he doesn't have title and he will apply for duplicate and will give you once I get it. Since it is 3 weeks now, i didn't get that title yet. Now car is giving some trouble and i asked him to take the car back and return my money. He is saying that i can't take the car back as you legally owned it. Give me couple of days more and I will get back you once I got the duplicate title. Can you please advise, what can I do to return him the car or shall I wait to get the title ? Really I don't like this car now as I faced lot of issue after buying this. Can you please help on this.
(Note : Car was registered on his wife's name and car sale deal was given by his name

He didn't legally own it, and therefore didn't legally have a right to sell it. Tell him you want ALL of your money back, or you will go to the police, and then do it if necessary.
He is lying to you, you don't legally own it without the title, and neither does he, his wife does.

He has made an illegal sale to begin with. By law she is the only one who could legally sell the car. You might want to get an attorney or file in small claims court depending on the sale price of the car. I would also file a police report saying the guy commited fraud. Call non-emergency line or go down to the police station in person. Do not call 911. I would give the guy one last chance and then tell him you are filing a police report. Tell him if you do not get the title transfered within 24 hours or your money back you are turning him in on fraud charges. Title transfers take minutes, as do dupilcates. He has run out of excuses.

He shouldnt have sold you a car w/o a title and especially if it was titled and registered in someone elses name. But you should have done some homework first if you didnt know how things need to be handled when purchasing a car. I would notify the secretary of state office and ask them what to do. Also if you are unhappy with the mechanical condition of the car that is your responsibility as a buyer to get those things checked out by a mechanic. All used car sales are sold as is without a warranty unless otherwise specified.

sounds like a scam to me, I would talk to a lawyer, or just take it to small claims court yourself, (if the car was under 7500 dollars)
I'm sorry to hear about this, there's rarely anything you can do in this situation, although the first guy did have a good point. If the sale contract you signed said "as is" in it then you're really backed into a corner, but small claims court is cheap and it's worth a shot.

NEVER buy a car without getting the title when you pay for it. This guy seems to be taking advantage of your ignorance of our laws. He can go with you to the DMV and sign over the car then and there. As far as him taking it back...You are out of luck. Used vehicles are sold as-is by private parties so there is nothing you can do.

You got scammed, sorry. You do not legally own the car unless you have the title. You are going to have to take him to small claims court more than likely. Go fill out a police report.

Your stuck with that car until you get the title and can sell it yourself. You can't even get a car crushed without a title.
Next time you buy a car, take a knowledgeable person with you.
