If there is no evidence, then there is no case.
Without knowing the facts of this case it would be hard to correctly answer your question, Generally speaking, the police cannot charge anyone if after they have investigated the incident, they still have no evidence. The CPS(in the UK) would not take the case on without a realistic chance of prosecution

These cases are always difficult - without good physical evidence and/or reliable witnesses it is unlikely to even reach Court.

just like any other case, the police can not proceed on hearsay they have to act on facts as they see it, this is exactly how you would require them to deal with a case of your own if someone accused you of an offence.
