My son was physically assaulted in school, was kicked in the face and head several times, and in his stomach. He spent a total of 6 hours in the emergancy room for his injuries. The school never called me to let me know he was assaulted, there was no punishment done to the other boy, who is older and bigger. And now my son is being charged with breaching the peace. I have also been charged by the other boy's mother for threatening them over the phone. I was called by them three times while in the ER with my son and again when I got home, with them threatening to charge my son with all kinds of things if I pressed charges against her son. So I made a comment that the one charging my son should be smacked in the mouth for lying and twisting it around. I never spoke directly to the mother. It was someone else who called me and the mother was there. So I was charged with profane lang. over the phone. I had just came home from the ER and was upset. Where do I find help?

I have filed charges. I even spoke to the school principle, the assisatnt priciple and the school board. They all say they didn't know he was hurt that badly. They sent him back to class after the fight and made him ride the bus home. Thats when I noticed the swelling in his face and head. Theother boys mother had a friend call me when I came home, and they were threatening to charge my son with all these bullsh*t charges so I lost my temper. Now the other mother says she will drop all charges if I drop mine against her son. I spoke to a laywer and he told me if my son didn't have permanent injuries then he couldn't helpme. They school also says that my son didn't start it. another child, not the one who assaulted my son, started it by spreading rumors. But again this other boy wasn't dealt with either. So now I am stuck with home schooling, which I don't mind, but my son should be able to attend school safely. Also my child has been charged with breach of peace.

My son could face detention for this according to the juvenile worker who is handling this. So I am charged and so is my son. Where is the justice. I thought assault was assualt. No matter how you looked at it. The court dates for all the charges have been set for the same day, and the juvenile worker is telling me because of that, the judge will throw it all out tell us to stay away from each other. It's not fair that this boy gets away with beating my son. I have seen this happen over and over again in our public schools and within the court system. My son was charged last year with a criome he didn't do, but spent time in detention anyway, and then passed a polygraph test proving his innocence! But still the courts willnot release him no matter what I do.
So where do parents go to be heard and make a stand for their kids?

I would call a lawyer. ANd the police. Physical assault is a serious crime and if the police do not act, notify the state department of law enforcement.

Even if your son was the instigator of the situation, that is not an excuse for the degree of physical assault the other boy used. And there is no excuse for the school not calling you when your son was at the hospital.

I agree with those people who suggested calling the police – you can always get a lawyer later if you think you need one.

first calm down and then go talk the teacher and then go to the principal. The other kid is bigger so you can hold him accountable for his actions on a younger child. It is not ok and I would definetly report it to the police and have them make a report. You never know this kid could have a record of violent behavior. Then ask the principal what she is going to do so it won't happen again. Talk to your son and get all the facts and if he needs to be disciplined as well. I would be upset too if I didn't get notified about something like this. Good luck and hope you resolve your problem.

Go to the local police and press charges of your own, get all the proof you can, Including the medical bills. Also contact the school and find out WHY you were not called about the assault, that doesn't make any sense whatsoever.

I would get a lawyer, and now, and file a police report immediately. I hope you took pictures. Don't let them threaten you. Also, contact the state school board immediately and file a complaint against the school administrators.

I hope your attorney suggests you sue not only that boy's parents, but also the school administrators and the school district. Good luck.

Write a letter of complaint with detailed description of the attack to the school superintendant. Attach ER bill copies. Have it notarized. Copy it and send to the superintendant, principal, school board (all members), your lawyer, and the police department. Hope there were witnesses to verify your son's innocence in this. Disgusting incident. Hope your son is healing.

Obviously you got proof of the assault (medical reports) so you can easily file charges. But get a lawyer since they say that will start to lay charges also.

Just make sure it wasn't your son that was the instigator.

It's time for an attorney. You can't be charged for saying stuff. Freedom of speech and all.

Even if your kid started the fight there are rules and regulations being thwarted here.

Personally, I wouldn't waste anymore time talking to anyone but a lawyer. Sounds to me like you have a case.

i cant believe ur situation
u might find alot of parents at school go thru the same thing and jus dont speak up
