these people down the street poisoned my dog with an antifreeze bone, he died. it really....really pissed me off..i loved that dog, i took my slingshot and shot out their windows of their car and house.. for being such assholes..and now theyre taking me to court for destruction of property. because their neighbor "saw the whole thing"

do i have a case? i mean..they killed my dog..theyre sick people and in my opinion deserved it...right?

i wouldnt really say im an idiot...but this had just happened...like two days ago....i was more blinded with rage then stupid in my opinon...but yeah...if anything like this happens again, ill "do the right thing" first..thanks....

Nope, you have no case. They committed a tort (allegedly) in killing your dog. You committed a separate tort by destroying their property. Courts just don't say "it's a wash," and they certainly don't endorse revenge.

The court is not going to say "yes, you're off the hook because they poisoned your dog." The court is going to say "I don't care if they did poison your dog, that's irrelevant. Did you bust up their windows? Pay up."

You can bring your own suit for their poisoning your dog...if you can prove it.

By the way, how did they give your dog the bone? Was it running free? Can you prove they did it?

You're going to get nailed for the destruction of property thing. What you need to do is contact the humane society and tell them what they did to your dog. You are looking at a misdemeanor or less for the property damage, but killing your dog with antifreeze is a guaranteed felony that will get a lot of people really angry with them and probably carry a stiff jail sentence and some probation.

2 wrongs don't make a right. You could have a case if you could prove they poisoned your dog....but you went out and broke their windows....that is destruction of property....you will suffer consequences for that. Just because you think they poisoned your dog, and I'm sure you are upset about it and if they did, they should suffer consequences for that...however, you should have let the courts decide their punishment...now you will be punished for deliberately breaking their windows.

I know how you feel. One of our neighbors poisoned my sister's cat "Taz" when we were in middle school. It didn't actually kill him outright, he started flipping out and having seizures we took him to the vet but it was so bad he had to be put down. It sucked. Can't say I'd hold the revenge scenario against you I'd still love to get that @$$hole back, though I think I'd rather take the slingshot to him than his car.

Sorry to hear about what happened to your dog,I'd go mental if anyone even tried to harm my dogs,unfortunately there are some cruel,evil people in this world.I'd put antifreeze onto their car,or whatever else they have of value,and I'd defo get even with them.My neighbours hate my dog,but I make sure nobody gets near her,she won't allow strangers near her anyway.Hope u get some kind of revenge on those bastards,it's them who should be dead,and not your dog.Take care, xxxxx.

If you can prove they killed your dog, you have a case against them for that. They would owe you for the property value of your dog. You can ask for emotional damages, but are unlikely to get them.

This does not excuse what you did to their house and car. You owe them for the damage you did. Be glad you aren't being charged criminally.

I am so sorry to hear that someone would and could do that... Hum. Let's see. Was it dark when you shot out the windows or? [I would hope you covered yourself with darkness, right?] If so, wouldn't it be heresay? Do they have a photo of you in the act or? If not, wouldn't it then be the same as you saying they did it? Same as the neighbor saying it was you that did it? He said, she said... Slight chance. Otherwise you are liable for damages. Sorry.

No not realy. As much as it was wrong of what they did to your dog, you should not have retaliated.

Unfortunatly, justice for animals is usually non exsistent. I mean, watch animal precinct and see how those ignorant losers treat animals and basically get a slap on the wrist...

You should have just went to the police or animal control and let them deal with it

Well you could say that they poisoned your dog with malicious intention, but you'd have to have evidence that they did, in fact, poison it on purpose. Your only defence is that you acted in revenge, and you could plead trauma or something --these are things your lawyer will advise you of more efficaciously.

I'll be pissed off too, but you will still be charged for the windows. However you can sue them for killing your dog.
Get a lawyer for your dog case.
