Do I have a chance on fighting on my own and not get my license suspended or do I really need a lawyer?

No, you were not charged with drinking illegally. You were charged with driving in the state illegally. Did any of your friends with .01, .05, or .08% in the passenger seats get in trouble, any of them? Only you? Hindsight, you should have been as smart as them. Know the law before you break it, lesson learned.

It doesn't matter if you hadn't slept or not. That won't make your blood alcohol be .05% due to not sleeping (not trying to be mean).

You went to eat, had some alcohol. Then you made a decision to drive. A lawman pulled you over in the course of you on your way home, or going somewhere else, but either way, you was behind the wheel while you was impaired.

If it is your first time, depending if this is all they got you on, the judge may go easy on you and depending on the State you are from. But the best advice, Please if you can't afford an Attorney, get the Public Defender to assist you. It's NOT WORTH loosing your license either way, just to make sure.

PLUS, YOU ARE 20, UNDER AGE..You didn't think.

Any time you have to go into a Court of Law to face a Judge on any time of Charges, especially charges like these, YOU NEVER GO IN UNPREPARED, NEVER WITHOUT AN ATTORNEY. YOU'LL GET CAUGHT WITH YOUR PANTS DOWN, so to speak and you don't want that to happen. The Public Defender is there to help, no Charge. So at least seek some type of help. Good Luck in this! But use a bit of wisdom next time. It has nothing to do with what you are drinking, nor IF you eat. IT'S THE FACT YOU ARE DRINKING ALCOHOL TO BEGIN WITH AND DRIVING. Be more responsible when you turn 21 since that is the LEGAL DRINKING AGE and if you want to drink, HAVE A DD with you!! That is the smart way to go. Call a cab, anything is better than you driving drunk and getting yourself killed or killing a family. Do yourself a favor: THINK NEXT TIME

You (or someone else) just asked this question recently. If it was you, are you going to continue to ask until you get a different answer?

Same as before- the law says that if you are under 21 and in the USA it is not legal to consume or be in possession of any alcohol (even a tiny amount).

So while you were in Mexico - you were legal. Once you crossed the boarder - you broke the law and got caught. A lawyer may be able to help you reduce the charge -but you would have to go and speak with a lawyer about it. I doubt that you would get away penalty free.

Next time you want to drink - stay in Mexico until all alcohol is out of your system.

It is illegal to operate a vehicle with blood alcohol level (BAC)over .08 if you are 21 or older and of over .01 if you under 21. You were arrested fro driving with a blood alcohol level in excess of the limit. It does not matter if you drank the alcohol on the moon, you drove over the limit.

"I just hadnt slept." - In most states, if you are tired and therefore operate the vehicle inappropriately, you can be charged with operating while impaired simply for that reason. You were obviously unsafe to drive.
" .05% is like having a beer!!!" - Does not matter, you are under 21. Consuiption of a beer in the US is illegal for you.

Depending on your state law, you could be in violatioon of the law as soon as you cross the border if your BAC is above the limit even if you are not in a vehcile.

Based on the facts you presented a lawyer will not get you off. He might get you a better deal, but he won't get you off.

You were driving in USA. Does not matter where it was consumed, it was consumed. Sorry, take this as a learning experience and get it over with.

Another question for ya...
At what EXACT point (.08, .09, .10, .22) should it be considered drunk? And if you have been up all night with no sleep should that level change?

Better yet, if your not responsible enough to find another driver after drinking, maybe any level of alcohol is too much. Maybe a license is too much responsibility.

You're done. If you are under 21, you can not have any alcohol in your system. Doesn't matter that you drank where it is legal. By the way, .05 is more than 1 beer and not sleeping makes no difference in your BAC. Get a lawyer and he can get you a better deal.

It does happen. I went through a checkpoint recently and it showed alcohol reading. The breathalyzer limits are almost 0 alcohol for young drivers where i come from so the readings are often because of this. Haven't heard of it happening to an adult.

It doesnt matter where you consumed the alcohol, they dont care about that!!! The thing that matters is it looks like it is under age drinking, AND driving under the influence, (they lower the standards when the under age part comes into play), looks like you made a bad decision, I would not waste my money on a lawyer, just pray to god the cop doesnt show up in court!!!
