When you grt paid weekly and work over 40 hours?

First, Are you salaried? If you are then overtime does not exist.

If you are hourly, then you should be paid, but there are some legal ways to get around it. You need to check your specific state laws.

Check the FLSA web site, overtime can be calculated two ways. Anything over 8 hours worked in a day or anything worked over 40 in a week, if you are paid by the hour and are classified as non-exempt. If you are classified as exempt you are not paid overtime, no matter how many hours you work in a day or a week.

If you are a salaried employee (in California where I work, that is known as an "exempt" employee), there is no requirement to pay overtime (there is also no requirement that you work a certain amount of hours). However, if you are paid by the hour, yes, federal and state laws say you must be paid overtime.

No it is not legal...It is illegal for an employer to not pay the employees overtime. If you work over 40 hours your employer must pay time and a half for every minute over 40 hours.

it depends on what type of job you have and how many people work there and how you are paid. my husband is a fireman and they don't get paid true time and a half for working overtime. it sucks but if he misses a day of work he doesn't get a smaller paycheck either.

If you are salary, they do NOT have to pay OT.
I believe they do if you are hourly. Even WalMart got hosed on THAT one!
