Is it illegal for a conversation to be recorded between law enforcement and an individual (when the individual is doing the recording solely on his behalf).

In the state I live in, it is illegal for anyone to conduct audio recordings of any police officer with out their knowledge.

But, a police officer can record any conversation they please at anytime while on duty.

As far as for the general public, you an audio record anyone with out their knowledge as long as it is in a public place with no expectation of privacy.

Its a Federal law that you can not record anyone on the telephone with out their knowledge.

As far as video recordings, you can video tape anyone, including the police at anytime as long as it is in a public place and not somewhere a person would have an expectation of privacy.

After answering this, I did some research... Apparently the audio recording of police has been repealed in my state as I can no longer find it on the books. So, they fall in with the laws that govern all recording of anyone.

Sorry about the confusion. I will always admit if I am mistaken!

You mean if the individual is doing the recording of the conversation? It would depend on your state. Here in Ohio, you would be allowed as only one of the parties needs to be aware of the recording. You could not record two other peoples conversation.

Depends, if you are in a single party consent state, you can legally record any conversation that you have the permission of a party to the conversation to record. It is ver easy if you yourself are the one recording and involved in the conversation.

If you are in a full consent state you need to get permission from all parties to the conversation.

In California, state law permits a peace officer to record conversations without notifying the person.

No. It is not illegal, as long as at least one party of the conversation is aware that the recording is being made.
