2 pilots are flying a plane. They speak 2 different languages and do not understand each other. 1 notices that the plane is at a very low altitude and trys to inform the other but the other pilot does not understand him, and thinks that he is saying that the plane is to high, goes low and the plane crashes.

Their superviser. He was responsible for assigning a safe crew to the plane. He should know his personnel well enough to know who does and does not speak what language and assign accordingly. This is if we are discussing a commercial flight.
If a personal flight with only the two pilots, it is equally both pilots fault for agreeing to copilot a plane with someone they do not understand. And I'm wondering how they could agree to fly together in the first place if they didn't understand each other.

Usually there is a pilot and a co-pilot. The pilot is to blame not matter what the co-pilot told him, because the pilot is in charge of the plane, and should know whether or not he was too low. Plus, there should have been an alarm or light or a guage that told him how low he was flying.
