Absolutely! California's bill mandates that a driver can only be fined if they've already been pulled over for another offense (speeding, aggressive driving, etc.), but in my opinion, just smoking with kids in the car should be enough to get you stopped. And the $100 fine should only be for first-time offenders. Every offense after that should double the fine. There's no excuse for smoking around children, and I say that as the daughter of a smoker. Maryland has started cracking down on smoking in public places and I hope they adapt this law as well. We passed a seatbelt law a few years ago and within a year, I was stopped for that twice. Shouldn't the same be done for endangering someone else's life?!

If they are your kids you are talking about then you can not have them in a smokers car. Otherwise, I think there is a much more serious child abuse going on. Im a non smoker but am sick of this crap about smoking and laws, make tobacco illegal period. Oh, i'm sorry the government makes too much money with it just like alcohol but wants to impose two sides laws, to allow it and to punish people for using it.

I think that smoking in a car with children should be allowed if you exhale only into a tube that leads to the outside of the car, so that the children are not exposed to the smoke (but not if you exhale normally into the air that the children breathe). E-mail me if you want me to give you the rights to this invention. I think it is a good idea but do not know how to develop and market it.

How about the parent that is driving down the road - talking on the cell phone - drinking coffee - and screaming at the kids to shut up because she cant hear her phone conversation????

Well I don't think smokers should smoke whilst driving whatever the case. I think it's just as bad as being on your mobile. I hate when I'm in the car with a smoker especially if i'm in the back seat because even if they put the window down the ash still blows back onto me and makes me smell of smoke.
I think it should be made illegal

If we do that, shouldn't every driver be fined for spewing deadly fumes from their exhaust pipe? After all, those fumes get into other vehicles. Everyone out there in traffic, kids included, breathes in a lot more of that than cigarette smoke.
