If some one is stealing, & they get caught, yes they will go to jail. He may get a lighter sentence, because of his problems, but he will have even more trouble getting a job if he is caught.

. Each case on it's own merit.
It may be possible that if the person HAS a job he may be put on a work-release program, that is, you are released from jail to go to work, You return in the evening, and on weekends.
The person may be put on probation under the condition he gets a job or at least looks for one in order to make restitution.
Remember, each case gets judged on its own merit.
Yes, he may be put in jail when he goes to court IF he is convicted. Upon sentencing, we will be given credit for time served. Suppose he is jailed, and a month later senbtenced to one year. He already was in jail for a month, he will then have to serve 11 more months.
Bottom line. YOU obey the law and stay out of trouble.

Stealing is a crime punishable by jail time. As for your "friend", it depends on the charges against him. If it's petit theft and a first offense, he may get probation and a fine. If he has multiple offenses it is more likely that he will get jail time.
If the charge is a felony, he will get jail time. He won't go to jail until he's been sentenced, unless he does something else stupid before then.
Moral of the story....DON'T steal. I hate theifs.

Absolutly not true. Each state has different sentencing guidelines. In PA, depending on the value of what was stolen there are different sentences. The lower the amount, the lesser of a sentence. BUT, even if you are caught steeling a .75 cent pack of gum multiple times, you will be charged at a higher offense. Once he is sentenced, he will be set a date to turn himself in. They ususally dont take you that day.

Ridiculous. If he steals, he commits a crime. Doesn't matter if he's holding down a job.
However, if he does have a job, his lawyer will at least be able to say, "My client holds down a job and is responsible." If the judge is stupid, it just might work to keep this guy you know out of jail.

Depends on what he has stole, how much he has stole (felony or not), his past history, the judge, etc. etc. etc.
There is no way to tell what the sentence of the Court could be.
If he gets caught and resists arrest that adds more charges.
