I got rearended 1 1/2 ago and I have got to go to a specialist and they won't except my health ins. and my auto is max. also, her ins. co. said they will not pay until I settle w/them. The specialist said they have a plan where it is like a credit card and you pay 11.99% ints. on it but her ins. said they would not pay the int on it if they find that I am going to the specialist due to this injury. So, what should I do? I really do not want to have to get a lawyer.

First, no lawyer is going to solve your problem. They are not going to pay your bills anymore than a 3rd party will pay as you incur them. Like it or not you are responsible for securing and payment of your medical treatment and being reimbursed at a later date for reasonabe costs associated with the medically necessary treatmen. Since you have health insurance, find a provider who will take your insurance. No medical provider is obligated to accept payment from an insurance company, but if you find one who does make sure they are part of your plan.

Even if you get a lawyer, the other person's insurance company will still not pay bills as you go.

Automobile Liability insurance is not health insurance - it has a completely different purpose from health insurance and does not act the same way.

It is common for liability ins not to pay until the end when it settles up in a lump sum - in exchange for you signing a release.

Why will the Dr not accept your health insurance? Is there another Dr that could provide the service who would accept your health ins? You may want to talk to your health ins and see what they can tell you. How does their plan deal with car accidents? Some health ins co will not pay for med bills related to a car accident. Some will pay and then go back against the liability carrier for repayment (when the claim settles).

1 and 1/2 what ago? Days, hours, weeks or years? Not that it really matters for your question, just curious. Generally you pay for treatment out of pocket or they wait until you settle, and once you are done with treatment only then when they know the full amount does the insurance company settle with you. They pay only for the necessary treatment that was a result of the accident, up to the limits of the policy, not interest or anything else.

Your best source of information regarding your particular case will be your insurance agent who can give you advice as to what to do and what to expect.

and you think a lawyer changes this magically? i love how people think lawyers solve all problems.

No matter who you run to.. it is what it is. The at fault party NEVER pays until you do a final settlement with them.

If they didnt do that.. people could try to accept payments for their injurie for years and years to com ewhen they didnt deserve it... "wow its almost christmas time and i need money for gifts... ouch my neck hurts so bad! time to call insuarnce again"
