New Jersey Law would put it at standard trespass... though Amtrak lines are covered as FEDERAL property.

The model State railroad trespass prevention bill accomplishes the following:

1) Makes entering or remaining upon a railroad right-of-way or other railroad property a misdemeanor subject to not more than a $100 fine, imprisonment for not more than 30 days, or both.

2) Makes stowing away on trains a misdemeanor subject to not more than a $1,000 fine, imprisonment for not more than six months, or both.

According to a recent Federal Railroad Administration (FRA) document, 20 States (Alaska, Hawaii, Idaho, Iowa, Kansas, Maryland, Mississippi, Montana, Nebraska, Nevada, New Mexico, North Carolina, North Dakota, Oregon, Pennsylvania, South Dakota, Tennessee, Utah, Washington, Wyoming). and the District of Columbia lack any codified law
that applies specifically to trespassing on railroad property.

Vandalism during trespass would be a FELONY.

by using the word train rails, I thinking guards. Hey it is against the law. I have not seen or heard of any body going to jail, but I have seen them die from it and I would say that you would get a big fat find.
If you are thinking about doing it - Don't
If you have done it and got away with it - Don't do it again
If you have done it and got caught - See a lawyer, he or she can give you the answer that you are asking.

Most of the time they will not take you jail for the first offense, but depending on the owner of the property. Most likely you will not get in trouble for it.

I would doubt the railroad would want to press charges. They would have to send a rep to court, and they are almost way, too busy to spare anyone. If you didn't steal anything, just walked onto RR property, then I think they would just fine you, at worse. Peace!

In Singapore if you are caught on track for no reason, you can be jailed up to 3 weeks.

You cannot be trespassed until you have been told by the police or security of the area that you ARE trespassing. When you are, the legal types log it. The NEXT time you are caught, and there's proof you know you are breaking the law, you go downtown.

unless you are engaged in otherwise dangerous or criminal activity, you will be escorted off the property.
It is an everyday occurence on the life of a railroad security agent.

Well if you went into private property, i would guess it was up to the owner of the land. But otherwise, maybe for half a week, or a couple days until bond?
