Lots of confusion here, but the LEOs above are all correct. Liquor laws never mention drinking alcohol ... that would be fatal. They refer to an 'alcoholic beverage'. Laws define an 'alcoholic beverage' as containing a certain % of alcohol. i.e. Canadian beer about 4% to 6%, U.S beer about 4%, wine about 11%, and the good stuff about 40%. So-called NA beer (advertised as 'low-alcoholic beer, not non-acoholic beer) contains only about .5% alcohol (point five %), about 1/10th the amount of alcohol in an average 'real' beer. It is brewed to that amount so it will always be well under the legal definition of an 'alcoholic beverage' and not subject to any state or provincial liquor laws that I am aware of. Therefore, so-called non-alcoholic beer (really low-alcohol) not being an alcoholic beverage by law CAN be consumed while driving. An officer stopping you, however, may very well seize the can and have it analyzed to ascertain if it is an alcoholic beverage or not. It's not unknown for someone to pour real beer in an empty NA beer can, so you had better have an honest face and not showing any signs of intoxication. You will likely also be subject to a roadside breathalyzer test to determine your BAC (Blood Alcohol Content) because your breath will smell of 'an alcoholic beverage' (not 'alcohol' which is basicly odorless). None of my answer has anything to do with anything mentioned above other than drinking and driving.

N/A is non-alcoholic, it Only contains 0.5% while the rest of your real beers contain 4.1% and higher. Because non-alcoholic beer contains such a small minuet amount of alcohol , it can be legally sold as not being a 21 and over type of drink. But be warned, there are a few states out there that have open container laws and you will get a ticket or go to jail for a DUI just for having a N/A beer in your car. But as far as being drunk off an N/A beer it's highly unlikely, I've never heard of anyone becoming drunk off of even 12 plus N/A beers or more. I've been doing experiments at home with my department store grade breathalyzer, it's showing I have a 0.2 after 3 NA beers, and I feel absolutely no buzz, I'm completely fine, nothing wrong. So I imagine if I was able to down 12 beers in an hours , the breath test machine would probably say I'm legally drunk. That being said, I've heard of people going to jail for a dui after just rinsing their mouths with alcoholic mouth wash at home just before driving and they blew over the legal limit.

Dog Lover; just to clarify... you contradicted yourself saying its legal but that the law states you cannot drink alcohol while driving...

Non alcoholic Beer actually has alcohol in it... its only 0.5 pct though... The correct answer would be no its not illegal to drink it while driving, unless you actually managed to get over 0.8 blood alcohol on it and test positive for being impaired... (that would require you to drink about 16 or so NA beers in the same span of time you would normally drink 2 beers for light weight person, so its not very likely... unless you lost a bet. In that case you are probably more concerned about being caught for speeding since you'd be about to burst unless you got to a restroom soon :p

No, it is not legal to drink Non-Alcoholic beer while driving. Even though beers such as O'Doul's claim to be Non-Alcoholic, they still contain a small amount of alcohol. This amount is usually equal to roughly one percent per volume, sometimes even less. However, due to the fact that they do indeed still contain alcohol, it is not legal to drive while drinking it, or drive with an open container of it in the vehicle.

Yes..... the law says you can not drink alcohol while driving. Not that you can't drink 'beer' while driving.

Any non-alcohol drink is fine, be it non-alcohol beer or a virgin daiquiri! Heck go for a Vodka Tonic, hold the Vodka!

It's not even legal to drink a bottle of water while you are driving. It takes your mind off the road. However, you would be charged with "drinking while driving (if anything), rather than DUI.

I f you look on the label you will see that Non Alcoholic beer still contains a small amount of alcohol. So you would still be drinking and driving.

In some states, such as Washington and Idaho, is is illegal to even drink form a can or bottle while driving because lifting the can or bottle to your mouth and tilting it back impaires your vision while driving.

As KCV, and DOG have answered, "near beer" does contain alcohol, even at a low percentage. Also many states have"open container" laws.
