ok two soldiers were caught in the NCOs room smoking. the NCO had themarijuana in his room (barracks) and so did the specialist, the pfc is a married solider and had his housing checked(drug dogs) which came up with nothing. what could happen to each one? theyve been interviewed and questioned PFC didnt want to tell on whos it was, higher command is lookin at it like the NCO was the influence on both soldiers considering hes higher rank(which he will get in trouble for hanging out with lower ranks) they all have done their urine analysis and were held for 24 hours? what could be next?
will they all get charged with possesion even f only two of the three had it?

its a stressful situation adn my neighbor is new at this whole military lifestyle and i just wanted to help her with some answer since i really dont know,
her husbands the PFC E3
ps we know hell get extra detail adn loss rank but how high are the chances of him getting kicked out? wife is 4 months preg.

more of a focus in whats going to happen to the PFC... the NCO is already getting booted dishonorable for all kinds of other reasons previous to this... the specialist hmm i have no idea and dont really care...

I am going to ignore the NCO and the Specialist because they will have problems of their own.

As far as the PFC. He will probably go for NJP with his CO. He will probably have a reduction in one pay-grade and potentially lose 50% of his pay for up to 3 months. They were already popped so he should have worked with the MPs...since he comes off looking guilty for not doing so.

I would say the chances of him getting pitched out are very low.... but I would also say his chances of going through the ranks quickly are very low as well.

Depends whether or not they get non-judicial punishment under Article 15 of the Uniformed Code of Military Justice or they go to a Summary or Special Court Martial. If it is an Article 15, their discharge cannot be ordered. Neither can a Summary (one-officer) Court Martial. A Special Court Martial could order them discharged with either an Undesirable or Bad Conduct Discharge. The Special Court Martial is the only one of the three where they will be representated by a lawyer.
The NCO's problem isn't that he was hanging out with lower ranks. He could be charged with being a dealer.

Couldn't say for sure what will happen to the E3 because I'm not his CO. I suspect he'll be offered an Article 15 just because he was in the area where it was happening. He'll lose some rank, money, etc, but what I'd like to know is why he was risking so much by putting himself in a situation like that knowing his wife is pregnant?

Well I am a military wife and in my husband's command they have processed out people for popping on the tests and having it. If her husband passed then he will probably be reduced in rank and forfeiture of half months pay times two, which is one whole months pay.
But if he failed the test he could be kicked out with other than honorable discharge. He will be knocked down to E-1. So, if she doesn't have a job she may need to get one, to help pay for bills.

I have seen many cases like this end with NJP where the administering officer says
You are fined, busted in rank and fired. 1/2 months pay for two months, one stripe and out.
