Depending on the state that you are in, it is most likely not illegal. There are few states that have set rules about what age & for how long a child can stay at home alone. Technically, charges can be pressed if it constitutes neglect. Again, this varies. LEt's say you are supposed to be home at 5, always home at 5, dad drops her off at 5, but, this one night he is a bit early and your daughter is dropped off at 4:50. This 10 minutes obviously doesn't constitute neglect. Now, let's say that you are due home at 5, but, dad gets tired of fighting with the child, and, drops her off at 9 AM, knowing she will be home alone for 8 hours. That could be considered neglect, paticularly if he didn't call you and inform you that she was there, or, if she was expected to cook or own meal or go without.

Lastly, assuming that he is charged with neglect, he will more likely be ordered to parenting class. Only in very rare cases does someone go to jail for neglect, and, that is virtually without fail, when the child has died.

Tell your attorney about it, because having it on record could help if you are seeing a 'pattern' of neglect.

Best wishes and glad your little one is ok~

I don't know, but perhaps you will find out if there is a court hearing, and the judge makes his or her decision in the matter.

Hopefully the judge will be in a bad mood and your daughter's father will learn a lesson.

I hope your 7 year old daughter is alright. hugs
