The marriage itself doesn't automatically change anything. The American would have to file various immigration forms with DHS/USCIS in order to make it possible for the spouse to become legal. But, it's a long complicated process, especially when the foreign spouse is here illegally to begin with.

No, u still have to file paperwork. If they came here illegally you are out of luck as well, they get a 10 yr ban. If you marry in their country then you file for a K Visa. You use to be able to marry a citizen and become one but they closed that law in 2002. It was a 245-i.

Have you not kept up with the recent news? If an illegal alien marries an American citizen, he/she is still illegal and can be deported. It makes no difference if they have children together; that will not prevent the illegal alien from being deported.
In the United States, it is against the law to marry an illegal to help them stay in this country. The legal person can be sent to jail and the illegal person can be arrested and deported. If someone is illegal and married a US citizen, THEY ARE STILL ILLEGAL.

The law changed about that, no longer are you automatically a citizen if you marry. You can marry a citizen and still be deported until you file the proper paperwork to be a legal citizen. So the answer is YES they are still illegal to be in the country no matter their marital status.

Not only are they still illegal, but the law allows them to be deported for 10 years with no chance of applying for a green card. After 10 years, they can be sponsored by their spouse or children (if they're citizens).

They are still illegal. Just because you marry a US citizen, does not make you a US citizen. Once married, they should go back to their orginal country. Apply for a visa, if they are married it is a lot easier to get one. Then comback to the US and work on getting their citizenship. You have to be married for 2 years inorder to get citizenship.

no, not until all the paper work is filed and approved. as far as the question of the 10 yrs and death of spouse the surviving spouse would have to apply for immigration benefits/status within 2 years of the death.

I don't think you can be 'automatically legal'. You have to apply for a Green Card. It should be much easier to become legal in the case of marriage to a US citizen.

I think they are, but after 2 years I think it is easier for them get citizneship. I could be wrong, but I remember someone asking me if I knew a woman that would get married to a romanian guy, so he can become legal.

Yes, but their husband or wife who's a U.S. citizen can sponsor them and they can get a green card within months.
