My girlfriend has an unsecured graduate loan which was taken out a couple of years before she met me. I have known her 2 years. She has got herself in a bit of a financial pickle when she recently lost her job and she has now been sectioned under the mental health act for harassment, and as I am living with her (not married) I am wondering if I am liable to make the repayments? I am worried about the prospect of bailiffs at the door. Can someone advise. Thanks. I am in the UK. Very Worried. :(

Of course you are not liable for your gfs debt. You should ask your self how much do you really like and care for her? Do you want to spend the next years together with this woman? If she does not like you without helping her financially then if it was me I would get out now. Good luck!

You are not liable on any debt unless you agreed to be liable at some point and in some capacity. Even if you are married, you are not liable on your spouses debts. A debt stems from a contractual obligation. You have to consent to liability.

The problem that some people get into is if they have joint property with a person. Then it is a matter of whether the creditor can force a sale of the property and take her interest. Otherwise, you have no liability.

A lot will depend on how far the relationship has gone and whether you both contribute evenly when buying things around the house.Of course the Bailiffs may issue threats against you and their actions are decided in Court before they can move on this. You must make your case clear to the courts prior to any judgement made. You may take the papers along to the Citizens Advice center the address of which can be found in the Telephone Book.

The only thing you are liable for is to run. Run fast. You sound like you are too young to be wasting your time starting your life out with so many problems. And no, you are not responsible for anyone elses debts except your own at this point, anywhere in the civilized world.

Good luck!

Sounds like you got yourself into a corner pal but you are not responsible for her debts and make sure that she signs or sells all her possessions to you or someone else before the bailiffs call as they can only take what is legally hers and nothing belonging to you and get receipts

No, not liable. In the US, we have community property law, which makes spouses liable for each others' debts, but if you are not married, then no. Is it the same there? I doubt that you would be liable just because you are cohabiting.

The only way you are liable would be if any of the debts are in both your names.
Are you in rented accomadation, if its in both your names get her off it.
Unbeknown to me, the day before, i married my ex he was declared bankrupt, even though we married no-one could touch anything that was mine

Good luck

so sorry to read your letter can you ask her doctors/ nurse to write a letter explaining were your girlfriend is to her creditors as they may be able to put payments on hold until your girlfriend can get her life back together as she will not this holding her back and adding more stress on her she is lucky to have you and its her loan I'm sure the letters will help

If your not legally connected to her, ie "signed any contracts" then your free to fly away..! For your mental health, I suggest you do before she drags you off to the looney bin! Unless your "crazy in love"?
