I was in a car accident. rear-ended. The ladies insurance paid me to get my car fixed. I have been having treatments from a chyropractor and they say they will pay the mewcical bills. however I am still hurting, my neck and back are giving me a lot of trouble. Am I still entitled to get payment for my pain and suffering even tho I am getting treatment.

Again, a bunch of dope kids screaming for you to get a lawyer. Newsflash -- insurance companies are NOT afraid of any lawyer. A lawyer CANNOT make your claim worth more than it is. No amount of extended or useless 'treatments' will make the claims adjuster pay you for that vacation condo you want. Yes, you are probably entitled to some 'pain and suffering'. How much actual suffering are you experiencing? Probably not very much so don't expect a bundle of cash. The chiropractor (or witchdoctor as we like to call them) is wrong about payment of all medical bills. They will be paid for awhile but if you don't show some serious improvement very soon you will be asked to see a REAL doctor. A damned chiro will keep you in 'treatment' for years but the insurance company will draw the line soon enough and YOU will be stuck with the bills. Same goes for a lawyer. He/she/it will promise the moon but will only drag out the settlement for nine months and end up with a settlement mere dollars above what a good adjuster will offer you. Add to this that the lawyer will take 1/3 of anything you get and you could be stuck with ZERO.

You do not need a lawyer. All a lawyer will do is take 1/3 of your settlement. The value of your injury claim will be based on the injury itself. Having a lawyer just changes who I talk to - not the value I put on the settlement.

The insurance company will not pay medical bills as you go (even if you have a lawyer - they still don't pay med bills as you go). The insurance company will settle up with you once you have completed treatment and are feeling better. The settlement will consider the medical bills, lost wages and pain and suffering.

Once you have completed treatment and are feeling better -the ins co will have you sign a medical authorization so they can order copies of your medical bills and reports. Once they get in all the bills and reports- they will evaluate them and settle up with you in a lump sum. In exchange for the money - they will have you sign a release that ends your claim once and for all.

My opinion - work with the ins co directly- if at some point you decide you don't want to deal with them, you would rather give some lawyer 33% of your settlement so he can deal with them then you can hire an attny.

If you are still having problems then you still need a lawyer. Do exactly what he, the lawyer, says to do. Do not let the insurance company cheat you. Get real medical help, X-Rays, MRI's. Get objective proof and let a layer deal with the insurance company for you. Do not get rushed into a quick settlement. Do not be trusting or stupid. The law is so complicated that even if you are in the right and they are at fault the insurance company can still screw you, and will. Yes, you need a Lawyer. I have had two injuries and played the trust game and lost out twice. Make sure you get a Lawyer who only deals in personal injury. Do not get a one lawyer fits all hack.

Call a lawyer, the insurance company would rather you settle this in their favor, cheaply. I would call one first thing in the morning. Generally I don't like to sue anybody, but I have been in the same situation that you're in and I took the advice of a friend who is a lawyer and they suggested that I contact a lawyer because the insurance company could care less about your interests
