Ok here is the situation i for 2004 i have to remove my self from someone as a dependent and file myself alone for 2004. for 2003 i did my taxes and i did not include a dependent i was suppossed to like i did for my w-2's in the paycheck stubs with work. i filed single and i need to include the dependent i had for work in 2003. for 2002 is the same as 2003 i need to do them again with a dependent for that year. i received a letter from the irs that i would have to do this correctly or face penalties. but if you think about it i will be paying alot in the tax agencys to do them again for each one of them. and so i was wondering is someone could help me on what i need to do, what forms do i need, and what i put on the forms, and how do i calculate the right amount. also if there is anyone thats a tax agent would be able to help me then he would get my bissness if he could give me a deal on what i have mentioned above on what i need to do so please do contact me if you are a tax agent.

Please keep in mind that i am 23 and i did do mistakes i should not have done its nothing illegal but there were mistakes i did not know at the time when i did them. ok. thank you.

to answer judy's question is no my parents did not claim me and could not claim me even now they could not so thats out of the question. what happen is in the beggining years i did my taxes with an ITIN and did not use my social security and that was one of the problems and so i could not claim anyone at the time. and the reason why i need to fix all this is becuase of immigration purposses i need to have this straight or i will and may get in trouble by not doing them right my lawyer said and i have already done 2006, 2005 correctly amd amended 2004 and 2003 for the person that had me as a dependent but i need to do on my own since i did work and i did not do my taxes myself so they have me as i earned something but did not do them correctly its kind of confussing to writte everything here i would really need to talk to someone either in person or on the phone. and i have already paid alot for the ones i already did amend already and its costing me alot i do not have.

OK, I’m a little confused by your question. Can you give more info as to just what the letter from the IRS said? Maybe that would make it easier to help you.

For 2004: You can’t remove yourself as a dependent from someone else’s return. If your parents claimed you and you also claimed yourself, one or the other of you has to file an amended return – that should be whoever wasn’t really entitled to claim you.

For 2003 and 2002, are you saying you had a dependent, like maybe a dependent child you could claim, or are you saying that you didn’t claim yourself but should have? In any case, from your question it doesn’t make sense, if you didn’t claim something but were entitled to, that the IRS would be requesting/requiring you to change that. And it’s too late at this point to get a refund for those years anyway. And I’m not sure what you mean by the dependent you had for work – are you talking about what you claimed on your W-4?

Please give a little more info as to who you claimed or didn’t claim for those years, and who if anyone claimed you. And were you a full-time student? Did you live with your parents?

Your narrative is a bit garbled, but here is my take.

The taxpayer that claimed you as a dependent needs to file an amended return, Form 1040-X. You have to file your own return. For 2003 and earlier, the statute of limitations for changes, up or down, has expired unless there was a late filed return or fraud. I can't figure out what happened without more details.

Call the irs...or go online and get the 1040 for 2004...complete the form as if you were doing it for the first time and write in over your name corrected return.
