U can preapre them with your last check stub BUT u cant file them until Jan. 1, 2008.

Technically, "2008 tax returns" means the returns on which you will report the income that you will earn in 2008, so Bostonia...'s answer 2009 is right and the answers that say January 2008 are wrong. However, I think you meant the returns that you file in 2008 reporting the income you earn in 2007; these are "2007 tax returns".

Technically, you could file as of January 1, 2008. Practically speaking you can't until you have received you W-2 or its equivalent if you are self-employed or otherly employed. You may also have to wait for the tax forms to be available or tax software to come out if you chose that route. Most likely you will not be able to file until some time in February.
