It really depends on the company and their policies. Usually collectors say you must pay in full; however, if you send in smaller payment they will take them. In addition, this usually prolongs legal action. You can pay with a money gram or money order, so they do not have your account information.

If they proceed with legal actions, normally while in court you can sign a stipulation. What this states is that you will make a set payment amount on a certain date until paid in full. FYI if you sign a stipulation, in some areas, if you default the company can go straight to wage garnishment without any notice. So be sure you only agree to an amount to can afford. Also, if the company does not know where you are employed- leave it that way, it is hard to garnish someones wages if you don't know where they work.
Good Luck.

Paying small amounts will NOT prevent them from taking you to court. If you are in collections, you defaulted on your contract. This means the debt is due and payable now. If and when the creditor takes you to court depends on how much and who the creditor is. Some waste very little time while others just sell the debt off to another collection agency.

If you are trying to work out a payment plan, remember that they don't want small payments strung out over years. They will probably take a lump sum payment of 50% - 75% as settlement.

Be sure to get any payment arrangements in writing and do not give them access to your bank account.

Taking to the court, garnishing wages are all big talks. Know certain things.
1) If the agency has contacted you and you have asked for a debt validation and they have provided with a satisfying validation only then they can go ahead and report to a credit bureau.
2) Its not so simple to take you to court and garnish wages. These are tactics these agencies use to squeeze out money.
3) Make sure whether you are out of SOL or not. If yes then the debt is not a liability anymore, if no then pay it. As it is you want to pay the debt, talk to your agency regarding your financial status and try to negotiate.
4) You have the FDCPA(Fair Debt Collection Practices Act) with you. I am sure you will be able to handle it.

Look you are not breaking any law. You own the debt and you want to pay it off. So why will you be scared by such threatenings?

It all depends. What state are you from.
If youre in texas, dont worry, they cant touch you, they can try scare tactics, trty to get you to pay in payments, even 50-70% from what you really owe, but if your unemployed, just change your phone no. and dont try getting any credit cards for a year, thats how they find you. Either you pay them all or none at all. You have to close up all your accounts or theyll never leave you alone. I know, they doing their job but dont let em get to you. Good luck.

They don't want to take you to court. They just want to scare the money out of you or send the information to a credit reporting agency to cause you embarrasssment. If you don't owe the money, sue the on who says that yoou do.

They will tell you anything and 99.999999% is lies just to pressure you into paying. If you want to set up payments, call the original company. If they refuse to set up payments, tell them thank you and good night

They are just saying that to frighten you. Google "collection rights" and see what you can find out. I don't think they can take legal action as long as you are paying something...pay what you can and don't let them get to you too much. Good luck :)
