You can but if the officer tells you to step back then do it,but why put yourself at risk the suspect could have a gun shot the cop then shot you and run off. Is it worth the risk of maybe dying to tape a traffic stop at close range?

A cop could legally order you away from the immediate scene if there is an incident that he needs to maintain control. But you can still move away from the incident and still videotape him from a public position.

For me, if a cop told me to shut off the camera or be arrested, my reaction would be, please DO. I can always use the money from the lawsuit. The same reaction applies if he confiscated the camera, or caused damage to it.

For you, only you can answer whether it's worth the consequences. Are you ready to go through a long fight over your rights? Not everyone is. Most cops will not put you in that position, though.

If they tell you that the tapes if made public will hinder an investigation for a stated reason then it might be a good idea not to make them public. But otherwise it is legal to tape public things. Cops, movie stars, politicians etc... There are some laws though in some states that you would have to be aware of.

Its perfectly legal. There's no law prohibiting a person from taking video during an arrest, as long as you are not obstructing. Besides, if those cops are doing their arrest in accordance with law, they should even thank you for documenting their arrest.

If the cop asks you to put the camera down and you did not obey, let him arrest you, so you can file charges against him for unlawful arrest. He can arrest you, but since the arrest has no legal basis (as explained above), then you can file charges against that stupid cop.

I believe you're protected under the first amendment. Freedom of the press is supposed to apply to all citizens. We're all potential freelance photographers, and an arrest is news.

Unless you are interfering with the officer, film away. You should obey his order to stop filming but if you weren't interfering, file a complaint.

Generally, it is legal, but be prepared to have you fil trashed or confiscated if they see you videotaping them.
