The following is my layperson's opinion only. This is all completely hypothetical.
There are no such cases that I know of. There are cases based in negligence to do with the passing of sexually transmitted diseases, but not based on pregnancy.
The pill cannot prevent pregnancy 100% of the time. It is not guaranteed. Neither are condoms, for that matter. Both are 99% effective when used properly (you can look up that stat if you like). If a person in your type of situation really want edto bring a case, they might consider suing the pill manufacturers on products liability. However, they would most likely lose because nothing is guaranteed to prevent pregnancy.
If you were to bring a case such as this based on fraud (or based on any theory, frankly), the judge would throw it out.
If this were a negligence type of case, the woman would surely win on the defense of "assumption of risk." I would (hypothetically) bet money on the judge dismissing your case on summary judgment based on the fact that you COULD HAVE had some control over whether you would get her pregnant (by using your own form of birth control, esp. a condom), and you GAVE UP that control, so you assumed the risk to the maximum possible extent.

No, and you are an A**. The pill is not 100% effective and neither are condoms but together they are really close. Many people in life have gotten pregnant while on the pill and if you were any kind of intelligent you would have researched that before you made the decision to take off your protection. Since you made that choice and she became pregnant then you need to own up to your responsibility and pay. She has every right to keep the miracle growing inside her and I hope that someday you get your head out of your britches and become a real father. You do not have a leg to stand on in any court and you will look like a real fool if you try. Get a grip and grow up!!!!!

You wouldn't have a chance at suing for fraud...it is your responisbility.
Maybe she could sue you for forcing her to "get on the pill."

She did that to get at you. Do you even know if she's pregnant? Is she showing?? She could be lying. Tell her your going to an appointment with a gyno or something with her to get proof she's pregnant first off. If it is yours you couldn't win to be honest cuz of paternity testing. I really can't say I blame you for you not wanting a kid or for not wanting to use a condom for that matter!! But anyway she should've gone on the shot honestly cuz it's more effective. Well good luck with it all and about the abortion--you need to pay for it cuz its probably your kid.

I don't know a lawyer who would take such a frivilous case because its unwinnable. Never have sex with a chick without a condom. All women lie about taking the pill or convieniently forget about taking the pill. Now that woman who said that she never wanted children wants to keep the baby. Why? Because most women want children. Think with your big head and not your little one. You're lucky that she didn't screw around and give you a STD. Man up and take care of the child.

I asked this before in a abortion group on another site, not about suing or anything, just about the legal status, and when it comes down to it, you have no right to sue her. Your partly responsible for not wearing a condom and taking the extra protection. You should have known though, no girl remembers to take those things.

To be honest with you, its a 2 way street. But if your man enough to have sex without a condom than you should be man enough to take responsibilty. I mean if she wants to keep the baby thats her choice. You cant make her give up something that also belongs to her. If you dont want to be in her life or the babies life well get the hell on. Cause she really dont need you, and that kid dont need a father like you. ANyawys good luck with losing your case! cause thats whats going to happen in that cause the law wouldnt be able to catch up with all the lawsuit files. lmao. Crazy
