this illegal was caught at the airport after working here in the usa with 59,000 that he was taking back to his country to build his family a home he worked 12 years and saved every dime and did not pay a dime of taxes but do you think the goverment should give it back to him?

Take the taxes out and return the rest of the money to the man as he is deported.

He was not paid in cash - he had paystubs to prove where he got his money from. So taxes were taken out, but he did not file taxes at the end of the year, but for someone who made $5.50/hour that is below the poverty level and if he did file taxes, he more than likely would have gotten it all back. If he made $5.50/hour working 45 hours a week at $220(regular pay) + $41.25 (overtime pay) that comes to $13,585 a year.

My opinion is that IF there was some taxes that had to be paid, then yes that money should be taken, along with interest and a fine, but the rest of his money should be given back to him so that he can take the money that he EARNED and go back to Guatemala and build the houses for his mother and his sisters. He wanted to leave anyway. The problem began when he couldn't read the forms that stated you can't take more than $10,000 out of the country without declaring it. He wasn 't trying to hide it - when they asked him, he told them how much he had. He just didn't know he had to claim it.

TheSweetestStar - Um, not really sure why you are talking about food stamps, housing, and daycare in this instance (although 2 those 3 programs are federally funded programs and all information such as SS# are verified before such services are given, I can provide links to prove that illegal aliens can't get food stamps, welfare, housing, etc. - and he didn't have any kids to be using the daycare)

Me2 - he showed his pay stubs to prove where he got his money.

First to who ever said someone would never be caught leaving with a large sum of money on an airplane, I thought after 911, we are screening all those who enter an airplane a little closer. Second I think there is some law about transporting large sums of money, to prevent illegal activity. I know that if someone ahd a lot of money in a suitcase, the authorities would hold them just incase its drug money or something. As to the guy said that he deserve it all,, because he does not have the opportunity to pay taxes, there is something called an ITIN, which allows him to pay taxes. Second he has an opportunity to pay now, with as DAR put it, Penalties and interest. I do think he should be held to examine how he came to the money, but should not do jail time in this instance. I think seeing a lost of 59K would deter him from doing it again, although having a suspended sentence might be justified if he's stupid enough to return

In a nicer world, yes - he should be able to take home some of the money he spent the last 12 years working for. But sadly there are laws that everybody has to follow, and we all have to pay taxes. He should have done things the proper way. :-)

Yes, but after he is audited and pays all his taxes, penalties, and interest on all the money on all his earning. As any American that is charged with tax evasion he should pay the price both in money and even jail time if a court decides it's needed, and then be deported. When I first heard his story I felt sorry for him, but when he spoke through a translator, he showed arrogance, and contempt for our laws. It was his defiance that he earned this money paid no taxes, broke our law by coming illegally and somehow he was the one that was being mistreated I also he might have gotten the money not washing dishes, but maybe a drug deal, why should we believe him. What is he still doing in the country was was he not deported. He did admit to getting paid under the table, and not paying taxes

First off never going to happen as immigration have nothing to do with you as you leave. An I-94 or I-94w is given to the airline at check in. The forward these on to immigration. It takes a couple of weeks for these to be updated into the system. So really, with that in mind the whole question makes no sense as it will never happen.

Think logically, if someone is here illegally are you really going to stop them at the airport & make them stay? Of course not, they leave & then you don't have to deport them.

On your way into the US you have to do a customs declaration form, NEVER ON THE WAY OUT. You could leave the country with $10 million & no US authority will know. You do customs in the country you enter so in this example if the person was returning to England he would have to make a customs declaration in England about bringing the money in (The US WOULD NOT KNOW).

If someome has been here illegally can you prove how long they have been here? If is on a visa over stay they can always say they left & just crossed the border from Cananda or Mexico again yesterday. Or when you enter the country it can take a couple of weeks to show you have entered due to processing delays.

The whole thing with illegals is a lack of a paper trail. He could say that he just came over yesterday without going through the proper border checkpoint & noone could prove any differently. Who can prove the money was earned in the states? He could say he just got here yesterday & he brought the money with him.

Really it comes down to this; unless you want to pass laws where any money can be taken of off anyone who cannot prove where it came from then his money must be returned. $59,000 is really not that much money.


BTW Am I missing the part of your question where you reference a MEXICAN????? A lot of other anserers are talking about Mexicans, I thought the question was about illegals, two totally different things!

IF he could read or speak English he would of read the sign No more than $10,000 to be carried out or into the USA> You forfeited it >No tax's payed>>So the fines & penaltys over 12 yrs is probley more than what he had>> To Bad it should happen to all illegals>And tax law breakers>>

They should give him his money back. All he wanted to do is GO BACK to his country and be able to have a home for his family, not STAY here illegaly. He did earn all that money (by working harder than I probably ever have). If he had payroll stubs, he probably paid payroll taxes.
I think he should have his money and go back to his country.

No sorry. Do not feel bad. He only got caught because customs found it and you have to declare anything over 10g. It sends a clear message to others not come here illegally and not pay taxes. Follow the rules and it wouldn't have happened.

No, all was obtained illegally because he was an illegal criminal alien. He broke many laws and should be deported, at his expense. The rest, the government should take in back taxes and penalties and such.

Have to agree with the majority here. As a US citizen we have RULES we have to follow and we really get tired of having to pay for ILLEGALS FOOD STAMPS, DAYCARE, HOUSING, and ETC!!!! We are supporting them, and UM, they cant even speak our language???
Sorry./ I dont have any sympathy for someone who comes to MY COUNTRY and dont follow OUR RULES that WE would get popped in jail for if WE broke........

Seems to me the only peeps with sympathy are Illegals...hmmmmmm Interesting
